Could DreamXD legally be charged with identity theft?

Clearly this is a crime on the DSMP since it's what c!Connor got locked up for. Could DreamXD be charged with it? Is that the real reason c!Sam wanted to build a god proof prison? Make your arguments for or against.

Important updates having read some of the replies:

While laws on the SMP vary, we do know that Utah and Ohio are canon to the Dream SMP, therefore I will accept any legal arguments that use either state's penal code as a basis.

DreamXD did not come first! We do not know how old he is, as when c!Foolish asked, XD said that was a rude question. He explicitly confirmed that he's mimicking c!Dream's form. The reason he gives is because "he was the first human I saw".

DreamXD's form shown is not his true form. It's a human form that he creates and it takes a great deal of energy to do so.

While c!Dream DID claim to not know who XD was during his interaction with c!Foolish (side note: incredibly funny of him to look at a statue of what's basically himself and be like "nope, no idea who that is"), we know for a fact he was lying to c!Foolish. Both because of XD's statement about having seen him first, and because from another of XD's statements that c!Punz brought him souls to eat (strongly implied to be c!Vik and !Lazar, meaning both c!Dream and c!Punz have met XD and know how to find him to give him souls) (1). Therefore, between that and the revive book, we can assume c!Dream knows who DreamXD is.

The answer is actually no, regardless of what laws are established on the dsmp, because what DreamXD is doing does not fall under the definition of identity theft.

Identity theft means 'fraudulently pretending to be another person, usually for illegal activity'. In a large majority of cases, the criminal does not bear any significant resemblance to the person they're impersonating. And being somebody's lookalike isn't a crime unless you're pretending to be them / are trying to trick people into thinking you're them.

To the best of my knowledge, DreamXD hasn't ever specifically tried to trick people into thinking it was Dream, nor assumed his identity on purpose. At best it has failed to correct people who make an assumption (ie that DreamXD is Dream) but that too doesn't make it identity theft.
