TIGA requires parcels companies to take reasonable steps to trace the true owners of undelivered and unclaimed consignments before disposal.

During the course of processing, consignments were accessed by APC Overnight. If these consignments contained personal data, it would have meant the APC was the data processor.

Under the Data Protection Act, they would have been required to process data appropriately.

I believe in many cases they failed to do so because personal data that they processed ended up with me.

The main point is that APC Overnight accessed the parcel consignments as part of their reasonable steps as per TIGA (Torts Interference with Goods Act).

The personal information in these consignments comes within definition of data as follows:

Consignments comprising of parcels, packages, packets and envelopes were being accessed by APC Overnight while being transported to their destinations – any information within was therefore being processed.

The contents of the consignments can still be data and therefore personal data as defined by the DPA (Data Protection Act).

APC Overnight is a courier firm failing to make even the most basic checks to ensure that customers get their goods back. This has meant the loss of extremely personal medical documentation, important legal documents and valuable objects. Even though courier companies apparently have the right to sell off lost parcels they have to make some checks.

I want APC Overnight to take back the stuff and deal with it properly but recompense me for my time and costs. From the evidence I have supplied it looks like the most basic checks have not been made.

Among the items include: 1. Sperm donor document. 2. MRI scans 3. Legal document – murder files 4. Insurance document – accident claims 5. Carphone warehouse job applications with passport details. 6. APC’s own bag of documents – disciplinary hearings etc

I have a full list of stuff and there are many other things that look interesting.

Hundreds of hours have been spent sorting through all the stuff. I’ve been on the phone trying to track down people. Owners have been identified to whom I plan to deliver stuff back.

I am continuing my efforts to trace back to sender and receiver a charge air cooler manufactured by Serck Heat Exchange.

The CAC was acquired from an auctioneer that disposes of undelivered and unclaimed consignments from various parcel companies.

Information I have so far leads to me to believe that:

1. The CAC was manufactured as part of refurbishment contract that Serck Heat Exchange (Unipart Manufacturing) had with Cummins.

2. It is a mk3 charge air cooler for QSK19 rail applications – traction cooler.

3. Cummins in Wellingbough service and replace these types of parts as they look after the rail fleet for Bombardier.

I do not have Cummins engine number so I have been struggling to get a Cummins part number for it.

Sometimes, during our product research we find the sender, the sender usually wants their goods back as our tracing back to sender demonstrates that the respective parcel companies did not take reasonable efforts to do so.
