Thanks to all who came out to support Ashanti in the federal court today. We were impressive, filling up most of Ashati's side of the courtroom. It was a victory. The federal judge said he didn't see her as a threat to society or that she would flee. (The federal prosecutor tried to use two missed court dates for traffic infractions as an excuse to retain her, but she was incarcerated on those dates and couldn't have made them.) The judge agreed to put put Ashanti in her grandmother's custody so she could go home to live until the federal trial. Ashanti could lead her own life, spend time with family and friends, and consider what comes next for her. No date has been set for that trial.

BUT

Ashanti was returned to the New Hanover County Detention Center because DA Ben David has not dropped the state charges. As it stands now she will be tried in both state and federal courts. How could this be? There are slight differences in the federal and state charges. But, as the judge noted, seldom does the state continue to prosecute someone who has been turned over to the federal system.

We need to take immediate action to stop this additional injustice. Please contact the District Attorney, Ben David, and ask him to drop the charges against Ashanti McLean.
