This is a civil case, not a criminal one. There wonât be time for what was filed on the 8th.

Money, pretty much. I imagine Michigan would fire him. Loss of reputation is really the big thing.Â
A civil case makes sense because a criminal complaint would be 100% he said she said; itâs why sexual assault cases in general have a low conviction rate. The burden of proof in a civil suit is considerably lower than in a criminal one. Â
Think OJ Simpson as an example. âNot guiltyâ in the criminal case, but guilty in the wrongful death civil case. Burden of proof has very strict legal definitions.
(Iâm not at all implying sheâs in it for the money; itâs just likely the only avenue she has. A DA would be very unlikely to take a criminal case in a situation like this).
Also, from reading the complaint and the dates mentioned, the statute of limitations on sexual abuse would have run out long ago so criminal charges couldnât be filed anyway. In theory Steve Penny/his predecessors/USAG could be criminally charged if there is actual evidence of ongoing coverup of a crime, but I highly doubt thatâll happen. Unfortunately with such a long time between the time of the alleged crimes and the lack of evidence, a civil case is the victimâs best option here.
Only more recent victims could pursue criminal charges, as this particular instance would have run on the statute of limitations.
Iâm proud of her for doing this. Going about it this way will have a much bigger impact than going to the press or something imo. People wonât just say she is doing it for attention (which is disgusting that people say that but its what happened in the Crosby stuff).

Larry has publicly responded in an email to an Indianapolis newspaper.
Nassar, a faculty member at Michigan State University who has treated the universityâs gymnasts, has not been charged with any crime. He said in an email to IndyStar that the former gymnasts have a âmisunderstanding of my medical care.â
âIt saddens me greatly,ââ he wrote, âto think that these gymnasts feel I offended them when I was trying to help them.â

USA Gymnastics has a hell of a mess to clean up. All the success of the womenâs program doesnât mean much when there might be sexual predators taking advantage of gymnasts in the system. I canât even begin to imagine other victims unaccounted for and others who were brushed aside despite coming forward. I donât think USA Gymnastics can afford to continue to sweep this under the rug like they have been, otherwise how can any parent or coach put their kid(s) in a system they canât trust?Â
I donât want to sound like I am glad this happened to the woman in the lawsuit; Iâm definitely not. But I think her coming forward is definitely going to have a bigger impact on USAG than other previous incidents because they canât sweep it under the rug as just some coach at a USAG-affiliated gym in rural wherever that they had little direct contact or oversight over. Not that they werenât negligent in those situations as well, but itâs harder for them to ignore or minimize this when itâs Larry Nassar being accused of miconduct directly under the noses of the Karolyis & Steve Penny & his predecessors. Obviously the Marvin Sharp situation hit closer to home than other regional coaches because he coached national team gymnasts but even in his case they kind of swept it aside. Not sure they can do that now that itâs clear this occurred on national team trips while the victim was directly under USAG supervision.Â
For those wondering about my comments about the 2000 US Olympic team, Iâm referring to this lawsuit that GymCastic posted today. Everything is there. Unfortunately the details are very graphic and disturbing, so read with caution.Â
