I keep seeing the thing about custom themes and wanted to say that that inclusion to the tos / guidelines has been there for over a year and from what I've seen its never actually been enforced when it comes to people using the themes. I think at the time theme makers were worried providing themes and not uploading them to the theme gallery would get them in trouble but I dont believe anyone's been punished for it lol
