Two Types of Drink Driving Offences

According to Road Transport (Safety and Traffic Management) Act 1999 (NSW)

1. Driving While Under the Influence of Alcohol 2. Driving with the Prescribed concentration of alcohol.

It is most often the case that police will charge you with the second offence because they will usually have a precise blood alcohol reading. The police will charge you with driving under the influence of alcohol, however, if they do not have a reading. This would occur if you refused to be tested, there was a technical problem, or there was some other reason why a reading could not be obtained.
