oh gosh I’ve got an ADA dilemma and question for anyone with an opinion, I’m not sure what to do:
Last couple years I’ve gone for a four day camping music festival with an ex partner, and this year I’m going alone. I was able to camp because my ex did the literal heavy lifting - I have a cranial nerve pain disorder and can’t lift heavy things, particularly in the heat.
I reached out to the festival and they offered me ADA parking and campsite access which would make camping super accessible to me however I don’t have mobility needs and don’t need my car within easy access - I just need the help from the ADA team with set up/need closer parking access to the campsites for set up/take down. I feel bad taking up a parking spot from someone who would need to transport mobility devices or has more severe issues, so I’m debating on whether I take them up on the ADA parking and camping access at all in the first place in lieu of someone who needs it for the duration of the festival. Any idea on what I should do??
On 645 5th Ave. in New York City, located in the lobby of the Oxford-Olympic Tower, Mobility Elevator has installed a glass and stainless steel wheelchair lift, known as The Prestige. This new addition adheres to the structure for the purpose of Americans with Disabilities Act (ADA)
Columbia University’s International Affairs Building has contracted Mobility Elevator to install a wheelchair lift to provide multi floor access and meet Americans with Disabilities Act (ADA) compliance. As stated in the ADA, “Covered entities must allow people with disabilities who use wheelchairs (including manual wheelchairs, power wheelchairs,
Okay. Rant time. (Its under a read more for everyone that isn't here for my awesome rants)
Today we had a choir concert.
And, I am at my college, and I am on a vocal scholarship.
Thus, according to my scholarship, I am required to perform with the choir, which honestly, is no problem with me, because I love music.
Anyway.
So due to the weather in Oklahoma that was headed in, I had to move my infusion from Thursday to Wednesday, and I found out about this, three hours before the appointment- which, by the way, is a three hour drive. So I had to madly scramble and dash to cancel my two remaining classes and drive to Oklahoma.
In choir class on Wednesday, my choir director decided that our choir performance would take place in the chapel balcony.
Which has no elevator.
And didn't inform me of this fact, and forced me to find out from a classmate.
And, fun fact, I'm IN A GODDAMN WHEELCHAIR BECAUSE I CAN'T WALK. Which includes climbing stairs, and because I kinda abused my cane a lot, my rotator cuff is fucked over and I'm not allowed to use my cane or crutches etc.
So. This is the email I sent.
"Professor XXXX, It's come to my attention there is a staircase between where we are singing and where we enter tonight. There is no ramp or elevator. Thoughts? I can't climb stairs and I am not allowed to put stress on my shoulder due to a rotator cuff injury which knocks out cane or crutches and my hip is currently dislocating upon pressure. Violet."
And this is what I got in reply.
"I am so sorry that I didn't think of this myself. I knew there wasn't an elevator. Could 4 people carry you up without hurting you? Two people carry your legs and 2 carry your upper body?? Too risky?? Would you be broken hearted to sit this performance out? I, of course, would not penalize you. Prof. XXXX"
Okay.
So. In this email, the professor does several things, that aren't okay. Such as: A) admitting she knew there was no elevator. and B) suggest an obscenely unacceptable mode of transportation that would not only cause intense pain, and be a danger to my safety, it would cause intense humiliation. Because the girls that would carry me would be my my classmates.
Its not acceptable.
So. Basically. I have the choice of not performing or being humiliated.
This isn't the first time that she has done something like this.
During the course of this semester she has forced me to get out of my wheelchair, use people as crutches and climb risers to the third or fourth riser into a chair that is already there; entirely ignored my wheelchair and blocked me running up and down stairs until the very night of the concert in which she decided it would be "okay" for me to stay in my wheelchair next to the choir, and various other unacceptable things.
The problem here? I HAVE TO TAKE HER GODDAMN CLASS TO KEEP MY SCHOLARSHIP.
THERE IS NO FUCKING WAY AROUND THIS WITHOUT FILLING OUT A GRIEVANCE FORM, WHICH I CAN'T AFFORD TO DO BECAUSE SHE IS IN CHARGE OF MY SCHOLARSHIP.
I am so fucked.
Just.
So.
Fucked.
And don't get me wrong, my college is amazing. I love their disability services and they go above and beyond. Its just this goddamn professor.
Thoughts?
