Algorithm To Aid Courts In Deciding Who Goes Fee
A unique mathematical formula, called algorithm, is now being used in courts to help decide whether a defendant can be released “on own recognizance.” The method is meant to screen an offender’s likelihood to skip trial; thus, removing the need to set bail.
The system was developed by data scientist and criminal justice researchers. It aims to put only the most dangerous defendants in jail while awaiting their trial. The system works by analyzing the severity of the defendant’s records and assessing from that information the probability of the defendant skipping their court day.
The algorithm speeds things up, but it is not fool-proof. It still cannot work independently because only humans got that important thing called “intuition.” The system can just do so much in assessing the case. In fact, the prosecution can still argue the situation and work to overturn the judge’s decision; going back to the same process again. Worse, a wrong release could result in a crime being committed.
Removing bail from the picture is not the primary solution. Instead of thinking of eliminating bail, it is better to think of ways on how to make the justice system work efficiently. Some people may say that bail bond doesn’t encourage a defendant to go to court hearings. Well, if financial commitment doesn’t, what will?
