Question: How Long Does it Take to Receive an Inheritance?
Answer: Well, the question depends on two things.
First of all, whether the decedent (that's what we call the person who died) had an estate plan and what type of estate plan that they had. If the decedent had a will or no estate plan at all, they'll have to go through the probate court process.
This process takes at least a year. Well, in Massachusetts is more than that and largely depends on a few factors like the court docket, if there's an overload there, and also if there's any conflict in the family
And either case, according to Massachusetts statutes, the probate matter has to stay open for at least one year, and this is to allow creditors the opportunity to come forward and present a valid claim against the estate.
Lawyers actually call Probate Court lawsuit, that you open up on behalf of yourself for the benefit of your creditors, but there are ways to escape this process altogether.
