A 32-year-old Chesterfield Township drunk boater was sentenced to 5-15 years in the Michigan State prison for causing the death of two people near Harsens Island.  He was driving his boat in a channel of the St. Clair River.  At the time of the blood draw his blood alcohol level was .105, or just over the legal limit.  But what if his blood alcohol level had been .085 instead of .105; what then?
