深度伪造技术的法律挑战及应对

近两年来，随着以机器学习为代表的人工智能技术的发展，人工智能自动生成内容取得了显著的进步，不仅内容的质量得到了提高，而且内容的形式日益多元化，例如生成文字、图像、声音、视频等。在此背景下，深度伪造技术“应运而生”，可以实现图像、声音、视频的篡改、伪造和自动生成，产生高度逼真且难以甄别的效果。深度伪造的最常见方式是AI换脸技术，例如deepfake、face2face等；此外，还包括语音模拟、人脸合成、视频生成等，以下统称深度伪造技术。

作为人工智能技术发展到一定阶段的产物，深度伪造的兴起主要归功于生成对抗网络（GAN）的出现和进步。GAN算法上同时搭载着两个神经网络——生成器，基于一个数据库自动生成模拟该数据库中数据的样本；识别器，评估生成器生成的数据的真伪。两者在互相博弈学习中产生大规模和高精确度的输出。随着GAN算法的不断成熟和日益复杂化，无论是图像还是声音、视频都可以被伪造或自动合成，并可达到几乎不能辨别真伪的程度。

我国发展人工智能具有良好基础。国家部署了智能制造等国家重点研发计划重点专项，印发实施了“互联网+”人工智能三年行动实施方案，从科技研发、应用推广和产业发展等方面提出了一系列措施。经过多年的持续积累，我国在人工智能领域取得重要进展，国际科技论文发表量和发明专利授权量已居世界第二，部分领域核心关键技术实现重要突破。语音识别、视觉识别技术世界领先，自适应自主学习、直觉感知、综合推理、混合智能和群体智能等初步具备跨越发展的能力，中文信息处理、智能监控、生物特征识别、工业机器人、服务机器人、无人驾驶逐步进入实际应用，人工智能创新创业日益活跃，一批龙头骨干企业加速成长，在国际上获得广泛关注和认可。加速积累的技术能力与海量的数据资源、巨大的应用需求、开放的市场环境有机结合，形成了我国人工智能发展的独特优势。 同时，也要清醒地看到，我国人工智能整体发展水平与发达国家相比仍存在差距，缺少重大原创成果，在基础理论、核心算法以及关键设备、高端芯片、重大产品与系统、基础材料、元器件、软件与接口等方面差距较大；科研机构和企业尚未形成具有国际影响力的生态圈和产业链，缺乏系统的超前研发布局；人工智能尖端人才远远不能满足需求；适应人工智能发展的基础设施、政策法规、标准体系亟待完善。

Rupa Chinai: Opening up new horizons!

As a print media journalist with over 25 years of working in the 'mainstream media', the introduction to multimedia journalism opens up a new dimension to my career and personal life goals.

As I see it, this transition from print to multimedia is vital for journalists. This is clearly the media of the future. It is a step forward because it breaks the stranglehold of large media houses, its corporate minded editors and the commercial interests that are shaping the filtration of news and what lies behind it. For independent print journalists who have long suffered marginalization in this setup, the ability to bypass this rat trap and reach out to a wider audience through multimedia blogging and websites, holds enormous potential.

A ten days workshop in learning multimedia skills and knowledge, organised by Indira Gandhi National Open University (IGNOU) in collaboration with the German media house, Deutsche Welle (DW), has introduced me to this concept. The best part of this course was the quality of the two teachers sponsored by DW, whose energetic, patient, friendly, high quality teaching skills, made each moment of the course so enjoyable and a great learning experience. I think I have absorbed quite a lot, but much depends on my ability to go home and practice, as also finding the technical support I will initially need.
