How Can Pool Owners Limit Their Liability in Case of Pool Accidents
A swimming pool can be entertaining and enjoyable, but it does include some liability concern that pool owners should be responsive of. Pool owners are usually held accountable for any injuries or fatality that may occur in or around their pool area, even in cases where a person injured or killed enters the pool without permission. It means that if people hop your fence, use the pool, and go away, pool owner is still responsible if anything occurs in the pool to cause injury. The fact that the pool owner is not informed of the pool being used does not release him/her of the liability. Pool owners are responsible to provide safety precautions with regard to their pool. A gate with an alarm and lock placed can be a pool safety cover. Some duties of pool owners include– 1. Proper safety equipment, like AEDs should be present near the swimming pool. 2. Properly trained life guards should monitor swimmers and perform their duties. 3. Use of pool rules signs, pool safety signs and depth markers is a must for pool safety. 4. Appropriate fencing is necessary in the pool area to decrease the drowning cases at the pool side. 5. Maintenance of the pool is a necessity. For example, diving boards must be safe to stand on and jump, pool water should be clean, areas around the pool should be safe to walk on, and pool drains, ladders, and sliders should be in perfect condition so that injuries can be avoided. Failure to provide warnings placed at conspicuous locations around the pool could turn litigious.
