Do these earbud cases infringe this design patent? Those are some of the claims at issue in this recently-filed motion for summary judgment.
Note: The answer in both cases is clearly no. The claim against the ridged case is one of the worst design patent infringement allegations I’ve seen. It’s no monkey tool (what is?) but it’s really bad. Remember, this design patent covers the actual shape shown in solid lines, not the larger design concept.
