Report against corrupt judge Jose Janello A. Cuvarrubias to Associative Justice Maria Filomena D. Singh
I wrote an Email to [email protected] to report a corrupt Philippine judge, do you think that any action will taken or will the Supreme Court cover the corrupt judge up? It's already passed a year, no action was taken at all.
Greetings Justice Maria Filomena Singh D.,
I bring to your attention the corrupt actions of Judge Jose Janello A. Cuvarrubias, presiding at Branch 47 of the Pasay Hall of Justice. Judge Jose Janello A. unlawfully ordered my arrest on two occasions without any valid basis and instructed a police officer to arrest me and confiscate my mobile phone. He convicted me based on a fraudulent complaint filed by a violent and corrupt police officer with the case-number M-PSY-24-...-CR. The officer’s affidavit of arrest directly contradicted his own testimony, and video recordings clearly show that he was lying. Despite this, Judge Jose Janello A. ignored the contradictions and the evidence. After seeing the CCTV footages, the fraudulent charge could not be sustained, but he invented another crime without properly establishing its factual or legal basis.
Don't worry I will not delve into the whole case, I just point out the most crucial parts:
Even a layman can see that the order issued against me is legally insufficient, as it contains no explanation, analysis, or reasoning whatsoever.
The failure to establish liability under RPC Article 148 does not automatically validate a charge under RPC Article 151. Even when a charge is downgraded, the judge is still legally required to establish all the essential elements of the downgraded offense. Judge Jose Janello A. Cuvarrubbias failed to argue, analyze, or establish the elements of RPC Article 151.
The entire action was fraudulent from the beginning. There was no lawful reason for the corrupt police officer, Raphael Bertos Jazmin, to approach me. The charge of simple disobedience is inapplicable because the complainant was not a person in authority over me. Judge Jose Janello A. Cuvarrubias incorrectly applied RPC Article 151 as disobedience to a person of authority. The law penalizes disobedience to a person in authority, and the distinction between “in” and “of” is material and determinative. No evidence was ever presented to prove that the complainant was a person in authority over me, and thus an essential element of the offense is completely absent.
Since I have no official, legal, or personal relationship placing me under the authority of the complainant, RPC Article 151 does not apply to me.
The complainant claimed that he was investigating me based on a fabricated allegation that I refused to undergo a screening procedure. However, no crime was committed in the first place, and no proof was ever presented that he was officially assigned to conduct such an investigation. An investigation cannot be invented after the fact to justify an arrest. CCTV footage shows that police officers had already approached the metal detector area and spoken with me and with the complainant, as shown in the attached image. They did not found any wrong, therefore did not arrested me.
If you read the testimonial of the policeman Raphael Bertos Jazmin and his affidavit of arrest you will clearly see, that the whole story changed. In his testimonial he claimed he was investigating because of the screening-procedure(the CCTV footage shows this is wrong) but later in his in court testimonial he said, he investigated against me, because somebody allegedly complained that I was nosy. The alleged complaint was also never proven and it's obvious that it's just another story.

We have seen that, the acts of Judge Jose Janello A. Cuvarrubias constituted a grave abuse of authority and a clear violation of due process. By ordering arrests without legal basis, disregarding objective evidence, misapplying the Revised Penal Code, and sustaining a conviction without establishing the essential elements of the offense, he not only committed serious judicial misconduct but also actively covered up the unlawful acts of a corrupt police officer.
Such conduct gravely undermines public trust in the justice system and cannot be tolerated. I respectfully urge Your Honor to take immediate and decisive action, and give me relieve of the unjust conviction. Accountability in this case is essential not only to remedy the injustice done to me, but to safeguard the integrity and credibility of the judiciary.
