Trademark can now be licensed electronically in India, with trademark search processes now automated electronically. Trademark essentials in India
In India, the 1999 Trademarks Act regulates the awarding of trademarks. Since India is part of the trade-related dimensions of intellectual property rights agreement also known as the TRIPs Agreement, laws comply with the TRIPs’ compulsory global provisions.
The following conditions for a trademark may be drawn on the basis of the act-
1. That has to be a mark
Although the concept of a mark is not exhaustive, it requires a number of components. A brand, it’s going, a name, a signature which can distinguish are all “marks.” Therefore, pictorial representations are often known to have markings, anything that has stitching on objects, colors.
2. The image must be able to be graphically replicated
Graphical representation means reducing it to a heading, mark, signature of name, word, letters, numerals etc. Nonetheless, there have been many technological advances in recent years. Sounds and odors will now also confer a trademark. In India, sound marks are subject to trademark law.
3. It may include the shape of the products, their packaging and a color combination
Let’s discuss what cannot be a Trademark in India:
No Color Trademark
Many big brands have faced problems due to color in their trademark. The Crucial criterion that the court should consider though is that the products are likely to be confused by an ordinary customer.
Placements are not usually permitted
When a location attaches distinctive characteristics to a brand name, under geographical signs it is more a case than a trade-mark. Companies must therefore refrain from filing a trademark which has the name of a town, place or state. In addition, certain names may be reserved for legislative or sovereign usage — such as National, certain names may also be covered under the Emblems and Names Act , 1950.
Contains scandalous, obscene content or is counterproductive to religious feelings
Any label which may be pornographic, improper can deny registration. In addition, a mark which can cause harm to feelings of a specific group of people cannot be identified.
A mark which displays only the quality
Terms like “perfect,” “best,” “superior” etc. are simply descriptive and thus cannot be a trademark. In a case involving Britannia Industries — the word “Celebrations” was not considered distinctive on the kit.
Named chemicals
Under the Trademarks Act, a trade-mark exemption cannot be issued to a widely used or recognized name of a chemical element or a chemical compound. There can also be no registration of a chemical declared by the WHO which acquires foreign non-proprietary names.
Names of people alive or deceased
Where an application for registration of a trademark attempts to create a link with an individual (living or dead within 20 years from the date of application), the trademark cannot be licensed unless the permission of the living person or representatives of the dead person is obtained.

Unlike the word says, professional tax is not just a tax levied on professionals. This tax is levied on any person earning a living through work, employment trade or calling. Professional Tax is a state tax that a state government imposes on account of the infrastructure it provides to you so that you can carry out your profession in that State.
As provided for in Clause (2), Article 276 of the Indian Constitution, State Governments are granted the right to levy and collect the professional tax. Most Indian states have also opted to not exercise this right. This tax is levied in all other States where appropriate, based on professional tax slab rates as implemented by the respective states. Neither state will, however, charge professional tax on any taxpayer over 2,500. Professional tax payment is permitted as a taxable income deduction under the Income-Tax Act, 1961.

A trademark is a logo, emblem, tagline or a combination of both which represents the identity of a brand. Often the Trademark Registrar poses objections to the intended trademark during the trademark registration process if it violates the rules and laws of trademark registration. It may be due to many factors, such as resemblance to an existing mark; offensive to a specific religion; lack of a distinct design; etc. In the event of a mark complaint, a detailed reply must be submitted within one month, from the date the complaint is raised.
Advantages of Trademark objection:
The following benefits are to file a timely response to a mark complaint, along with supporting facts.
· The current trademark will be protected from being lost or withdrawn, and for further processing considered.
· If the reply quoted cites the uniqueness of the mark, the probability of it being registered is small, thereby shielding the mark from infringement.
· Some businesses continue using the TM label while the Trademark registration report is still waiting. It is easier to lodge a trademark appeal against the registrar in case of opposition, rather than file a new application.
Where to File a Trademark Objection Reply
The status of the trademark in the Indian Trademark Registry would be classified as "Objected" when an objection is raised. In case of a trade mark complaint, the following are the steps to file a response:
Trademark Opposition Analysis:
The first step includes carefully examining and researching the complaint, because any confusion in interpretation can lead to incorrect filing of Trademark Opposition Answer.
Drafting of Trademark Opposition Response:
The next step is to draft a reply to the trademark which will include the following:
A correct response to the complaint posed in respect of the rule of law and precedents and decisions concerning the case Discrepancies between the trademark and the applicant's trademark.
Other supporting documents and proof validating the answer. An affidavit detailing the mark's use on the applicant's website and on social media channels;
Trademark Hearing:
If the response is approved, the application for registration and ads will be further processed in the Trademark Journal. If it is not approved, or further clarifications are requested by the Trademark Examiner, a trademark hearing will be held and the same would be informed with a note.
Publication in the Trademark Journal
If the result is favorable at the hearing, the mark is approved and ordered to be published in the Trademark Journal. The Rejection Order shall be issued in the event of a negative result, stating the reason for the rejection. The applicant still would have the option to appeal the order by filing a review petition within 30 days from the date of the Refusal Order mentioning the grounds on which the order must be reviewed.
Registration
Once the trademark has been published in Trademark Journal, it will be subject to review for a four month period. When no opposition from a third party is lodged during that time, the mark will then proceed towards registration and the certification of registration will be released. When an appeal is lodged the opposition proceedings must take place in compliance with the law's established rules
Documents Required:
· Authorization letter
· Affidavit of usage
· Examination report
· Trademark hearing notice
· Documentary proof of Trademark in commercial use.
· The duly appointed applicant or the attorney has to appear before the authorities, on the scheduled date
What to do if you missed the trademark examination reply deadline?
The deadline is determined depending on the actual receipt of the exam paper. The deadline for filing the reply to the opposition will be 1 month from the report's receipt date.
If by any case the trademark application left unattended and there is no reply received then that application will be abandoned without any continued communication.
