#BRUNSWICK, Ga. — The district attorney who would have prosecuted the case of a man gunned down while jogging through a #SouthGeorgia neighborhood is now responding to claims that her office blocked the suspects from being arrested. District #Attorney for the #Brunswick Judicial Circuit Jackie Johnson recused herself from handling the Arbery case just days after the jogger's Feb. 23 death because one of the suspects in the case, #GregoryMcMichael, used to work as an investigator in her office. But new allegations from a Glynn County commissioner accuse her office of preventing #McMichael and his son Travis from being arrested after the incident. Commissioner J. Peter Murphy told 11Alive over the phone Friday that the Glynn County Police Dept contacted the district attorney's office within a day or two after the shooting. Murphy claims they were told by "representatives of the DA's office" - not the DA herself - not to make arrests in the case. He said he wanted the community to know that a lack of an arrest was not due to inaction on the part of the Glynn County Police Department. However, in a lengthy statement, Johnson's officer refuted those claims, placing blame on the police department. "It is unfortunate that Commissioners Murphy and (Allen) Booker have chosen to make false accusations against District Attorney #JackieJohnson in an attempt to make excuses and ignore the problems at the #GlynnCounty #Police Department, for which they are ultimately responsible," the statement read, adding that the acting police chief indicated that it was a mistake that then-Police Chief John Powell did not immediately call in the #Georgia Bureau of Investigation. The #districtattorney's office added that it does not have arrest powers; it only advises on the law. "If the Glynn County Police Department is unable to make a probable cause determination on its own, why do we have a Police Department?" the statement continued. "Our District Attorney's office’s willingness to assist law enforcement officers on matters of law is now being used by the Glynn County Police Department as an excuse to pass the buck and fail to act." Allegedly Gregory saw Maud peak into a window of an under construction home which triggered him to then call on his son to bring their guns and take a ride to pursue him. The two attackers are not in custody at the moment due to Corona Virus and are claiming this to be a "citizens arrest" after previously reporting to authorities that it was self defense. • Personally this whole situation doesn't sit right with me. The fact that the video recording was premeditated shows that this was a set up. Prosecutor Who Didn’t Charge Ahmaud Arbery’s Killers Facing Prison Time - REAL NEWS TODAY

A grand jury had decided that the former Georgia prosecutor who initially decided to not press charges in Ahmaud Arbery’s death last year used her power to protect the 2 men involved and should now face charges of her own.

Georgia Attorney General Chris Carr announced Thursday afternoon that former Glynn County District Attorney Jackie Johnson has been indicted on charges of obstructing a law enforcement officer and for violating the oath of a public officer. She may now spend as much as six years in prison.

“Our office is committed to ensuring those that are entrusted to serve are carrying out their duties ethically and honestly,” Carr stated in a statement Thursday. “While an indictment was returned today, our file isn’t closed, and we’ll continue to investigate in order to pursue justice.”

The decision follows a state investigation into the 4 days that followed the fatal shooting of 25-year-old Ahmaud Arbery, during which Johnson’s office didn’t charge anybody involved in the shooting. Johnson instead chose to recuse herself from the case, citing that one of the men involved in the shooting of  Arbery, Gregory McMichael, once worked as an investigator for her office. It’s been previously reported that McMichael even called Johnson shortly after the shooting.

“My son and I been involved in a shooting and I would like some advice right away,” McMichael stated in a voicemail. “Please call me as soon as you possibly can.”

As a result of conflict of interest, Johnson handed over the case to District Attorney George Barnhill, however never disclosed that she’d previously sought advice from him in the case, according to the indictment.

For the charge of violating her oath of office, Johnson is accused of “showing favor and affection to Gregory McMichael” throughout her investigation into Arbery’s death and failing to treat the Arbery family “fairly and with dignity,” based on indictment documents released to the general public Thursday. The crime is punishable by as much as 5 years in prison.

On the obstruction charge, Johnson is accused of preventing two Glynn County cops from arresting Travis McMichael. That is punishable by as much as 12 months in prison.

In February 2020, Arbery was jogging through his neighborhood in Brunswick, Georgia, when he stopped to take a look at a construction site alongside his path. Gregory and Travis McMichael noticed the Black man and suspected he was involved in a string of burglaries in the area. Hoping to carry out a so-called “citizen’s arrest, the 2 males, joined by their neighbor William Bryan, tailed Arbery in their truck.

Armed with a pistol and a shotgun, the McMichaels confronted Arbery by blocking his path with their automobile. After an exchange of words, a scuffle over the shotgun Travis was holding followed. A total of three shots had been fired, killing Arbery.

Although Arbery’s death nearly went unpunished, footage of his death captured by Bryan, caught the eye of outraged activists. In May 2020, after the footage had gone viral and demands for justice reached an all-time high, Gov. Brain Kemp asked the Georgia Bureau of Investigation to take over the case from Barnhill. In less than two days, the state agency would take the McMichaels into custody and charge them with murder.

Barnhill, who had recused himself after Arbery’s family discovered his son once worked for Johnson, had decided that the McMichaels actions had been legal under the state’s citizen’s arrest laws before dropping the case. These laws have since been repealed.

Last November, after a decade in office, Johnson failed her re-election bid due partly to her involvement in the Arbery case.
