The crime of "Involuntary Manslaughter" - A Former D.A. Explains

Involuntary manslaughter is the lowest form of homicide in the penal code. And basically, it applies in a situation where you accidentally kill a person, but you're doing an inherently dangerous act. Or you're doing something illegal, but not amounting to a felony. If you're doing something that is a felony, then presumably the felony murder rule would apply; you'd be charged with murder. So it's a situation where you accidentally kill someone, and it's clear that you had no intention of killing the person. But because you were behaving recklessly, the law holds you accountable and says you should be liable for this crime of involuntary manslaughter. And a very classic example that was in the news recently involves Dr. Conrad Murray in the Michael Jackson death. And Dr. Murray was administering propofol to Michael Jackson which is a very serious, a dangerous drug that should be used in surgery or as an anesthesia. And he was administering this, basically, as a sleeping pill and was not monitoring Michael Jackson properly and didn't have the right equipment present. And consequently, Michael Jackson OD'ed, and he died. And Dr. Murray was charged with involuntary manslaughter and went to trial and, ultimately, convicted of this charge. If you're convicted of involuntary manslaughter, you could face up to four years in state prison. So it's very serious. With that said, we find that a lot of innocent people get wrongly accused of involuntary manslaughter, and for a number of reasons. One reason is that, a lot of times, it really is just an accident. A lot of times, we find that the death was an accident; that our client was behaving responsibly; that it wasn't foreseeable; and that it wouldn't be reasonable to hold him liable for a crime, certainly this serious crime of involuntary manslaughter. And sometimes we find that it was really another person who was behaving recklessly and caused the death or was responsible for the death, but the finger got wrongly pointed at our client. The Law of Homicide

Hello, my name is Chris Morales, I'm a criminal defense attorney in San Francisco, California. I'm a board certified specialist in criminal law and today I want to go over the basics of homicide. Homicide law, there are four types of homicides. There is first degree murder, second degree murder, voluntary homicide and involuntary homicide. So, first degree murder of course is the most serious it is an expressed malice type of crime and in other words the killer intended to kill the other person and had a motive and had malice towards that person. Second degree murder is not quite as serious it is still - the killer had the intention to kill the deceased, but they may have not had the motive and the malice that a first degree murder would have. Number three we have voluntary manslaughter, there are two types of voluntary manslaughter. Imperfect Self Defense and that is if you kill someone believing that you are defending yourself, but actually a reasonable person standing in your shoes would have not believed that you were in danger - that is imperfect self-defense. There is also heat of passion type of murder and the typical case is a jealous husband comes home finds wife in bed with lover and kills both of them in a fit of rage. Those are manslaughter type of cases, but then there are in-voluntary manslaughter type of cases where the defendant did not mean to kill the other person, but they still did. A typical case would be in a DUI type of accident where somebody is drunk and they get into an accident and the other driver or passenger is killed. They did not intend for that to happen, but they committed a crime because they were acting recklessly and in a dangerous fashion. So those are the four types of homicide.
