NMIMS students won't be allowed to sit exam: HC
The Bombay High court on Tuesday refused to grant interim relief in the form of allowing the 17 students whose admission was cancelled by Narsee Moonjee Institute of Management Studies to appear for their semester exams, which begin today.
The institute had cancelled their admission after they were found to have secured admission using fraudulent means.
A division bench of justice SJ Vazifdar and justice KR Shriram said, “In a writ petition, we cannot decide the guilt of the students that is subject matter to be decided in a suit proceedings, thus we are not inclined to grant any interim relief to the students.” The court will on Friday pronounce its judgment on whether the students were victims of a scam or part of it.
The court considered the facts of the case, where students approached a career guidance institute which promised them admission to NMIMS under the management quota (discontinued by the college since 2010) without them having to appear for the mandatory Common Entrance Exam. The bench said, “The reality is this, such things are happening and people are falling for it. If this practice is allowed, it encourages ‘agents’ to run around in society. We are disturbed by this situation.”
