There is always more than one side to every story. I’m sure you as the reader have been on different sides of various unfortunate circumstances during your life.  This is my story, an unfortunate one, where I was UNKNOWINGLY DRAWN INTO another man’s scheme, and paid a very steep penalty.  I write this because occasionally my competitors call into question my credibility or integrity.  They know nothing of what really happened, they only seek to plant seeds of doubt. I declare here and now that I am an honorable man, operating with the highest levels of integrity to serve my clients and support my family.   This is my side of the story.   Youthful Enthusiasm I attended Ohio State University graduating in1966. Some years later, I decided to pursue a career in law.  I think I had always wanted to be an attorney.  I attended and graduated from U of Miami Law School. I  moved to Florida in 1986 to be closer to clients who needed more of my time.   I BUILT a large practice in S. Florida, with offices in W Palm and Boca. Much of my time was focused on real estate in Palm Beach.  Specifically, I worked with international clients, which led to many overseas trips and adventures with and on behalf of my clients.  I made many friends, and I am proud of my service to my clients.  At home, I was actively involved in the community, including the Opera, Philharmonic, MANY COMMUNITY  and political organizations.  This was a very enriching time of my life.   Insurance I wish I had never gotten involved with insurance.  My association with the Insurance community began with a client who was a policeman in South Florida.  I handled some real estate transactions for this client, eventually representing him when he bought an insurance agency. Around 1998 my client and then friend shared with me an amazing new investment opportunity, Viaticals. These are interests in insurance policies of folks who have sold their policies to pay for meds etc.  This was very popular at the time.  There were plenty of sick folk who needed access to money just to make it another month. The return on investment was really good. It was hard to say no to such an amazing opportunity, so I began to invest in viaticals with him. EVENTUALLY I was asked to become the escrow agent for the company.  The company actually selling the investment was in Fort Lauderdale, while my client’s company had the sales force of insurance agents around the country. All that Shines is Not Gold I met the 2 attorneys for the investment company at their office and they explained how they operated, showed me the documents, and I saw nothing out of order.   But in an abundance of caution, I met with a third attorney who specializes in insurance law and represented large insurers.  This attorney had very strong political ties and was very close with the Florida Insurance Commissioner—Bill Nelson, former astronaut and now U.S. Senator.  I felt like I had covered my bases and could proceed with confidence.  I became the escrow agent and he became their attorney.  I invested $220,000 with the company, thinking this would be my retirement funds. The Nightmare In 1999, the FBI met with me and told me this was a scam and they wanted me to be a witness. These guys stole 117 Million.  The problem was I knew nothing as I only received documentation and processed the checks from investors. SO I COULD NOT REALLY HELP THEM.  This was a BAD movie, a story, no way this really be happening to me. They prosecuted several people including the OWNER OF THE COMPANY  WHO WAS THE ring leader.  He got 55 years.  My client later got 25 years. After a year they decided to prosecute me because they said I should have known.  EVEN IF TRUE THIS WOULD ONLY BE A CIVIL ISSUE NOT CRIMINAL.  Maybe they were right. Maybe I should have BEEN MORE CAREFUL. I wish I had. I would  HAVE run. They charged me with one count of wire fraud.  When it came time for the trial they told my attorney I could plead GUILTY TO THE ONE CHARGE or they would charge me with 9 more counts, which meant I was facing 50 years IN PRISON.   AS WE LATER DISCOVERED, THE INSURANCE ATTORNEY WHO WAS SUPPOSED TO MAKE SURE ALL WAS LEGAL RECEIVED A MILLION DOLLARS UNDER THE TABLE AND WAS NEVER PROSECUTED.  DID HE THROW ME UNDER THE BUS?  YOU CAN DECIDE.  APPARENTLY HIS political connections kept HIM out of the fire, and that’s likely why they had to turn the heat up on me.  In any case, I served 4 years.  4 years of my life was a terrible price to pay. BACK TO SOCIETY When I returned home to West Palm Beach, I had no money and no job.  This was a very difficult time, having lost everything; I wasn’t sure how to proceed.  I could no longer be an attorney.  The nightmare was over, but the future was so uncertain. The real challenge to moving on has been trust.  When you have been misled or betrayed, it’s difficult not to think it could happen again.  That’s why I am so diligent for my clients.  They need someone to trust.  I’m not mad or bitter about what happened.
