CLAUSES THAT MUST BE NEGOTIATED

1. Rent – The rent clause of the agreement must be considered and negotiated by the tenant before entering into the contract since it is the most vital part of the lease.

2. Term – When does the lease commence, does it commence when the lease is signed, when the keys are turned to the tenants, when the tenant opens for business or some time other than that.

3. Personal Guaranty – Is a personal guaranty required, if so, can it be limited in time or amount.

4. Permits – What are the tenant’s option if tenant is unable to obtain the necessary governmental permits in a certain reasonable period of time.

5. Default – On defaulting the payments, what will be resulting consequences for the tenant and the remedies that can be availed during such period of time.

6. Utility and tax – Maintenance charges and taxes are often paid by the tenants themselves. It must be taken into consideration before entering into agreement.
