yesterday I started crying while writing my memo on state access to dna testing and exculpatory evidence in post conviction proceedings because I was researching California’s state constitution due process approach and learned that California courts have repeatedly emphasized human dignity to the point of having “a dignitary interest” designed to recognize a person’s inherent worth and human dignity, and this particular case noted that the federal due process analysis often risks treating people like nonpersons with no dignity or value…and I was just like trying not to cry thinking woooow imagine if our federal Supreme Court gave a fuck about the inherent worth and dignity of every human being…
