457 Nomination and Visa Approval for Occupation Change
Tony first lodged his 457 visa application back in November 2016 as a cook after he completed his Certificate III, IV in Commercial Cookery and Diploma of Hospitality. While his visa was being processed, on 18th April 2017 the Department of Home Affairs announced the 457 visa will be abolished and replaced with the completely new Temporary Skill Shortage (TSS) visa in March 2018. This reforms has impacted many applicants as it resulted to a significantly reduced list of eligible occupations. In addition, reduced visa period of grant and further restrictions on certain occupations. These changes applied to all 457 visa applications that were pending for a decision as of 18th April 2017, and all future applications. The new changes have a major impact on Tony as his occupation “Cook” fall under the Short Term Skilled Occupation List. His 457 visa was eventually granted in July 2017 but being a cook will not give him a pathway of getting permanent residency through employer sponsored visa. Our migration agent advised Tony to change his occupation from Cook to Chef which will give him a pathway to apply for permanent visa down the track. Tony’s employer took our advice and was promoting Tony as a chef for the restaurant. On 21st November 2017, we lodged a nomination application for a Chef for Tony with the same employer and subsequently lodged his visa application on 27th February 2018. Both nomination and visa applications were granted on 13th September 2018 without requesting for further documentation. Tony is now eligible to apply for a Subclass 186 after 3 years under the TRT Stream.
