Opposing counsel sends me an e-mail to complain about not sending them notification of a conference.
My reply entails a description of the events during which opposing counsel was in the room to select the date jointly and may, in fact, wish to better manage their calendar.
"Lincoln lawyer"
Apparently, the term "Lincoln lawyer" denotes shady or otherwise incompetent counsel.
If you are at a case conference and ask for cases supporting trite law, you may be a Lincoln lawyer.
If you are surprised that opposing counsel does not believe everything can be resolved on consent, after exchanging conference briefs indicating opposing positions, you may be a Lincoln lawyer.
If your counter offer is less than the offer made to you, you may be a Lincoln lawyer.
If you consent to Orders that prejudice your client despite opposing counsel having no grounds to request them, you may be a Lincoln lawyer.
If you advise opposing counsel that your case load makes you too busy to provide disclosure, then cite an abysmally low number of active files, you may be a Lincoln lawyer.
No one should be subjected to all of the above in one conference.

Why would the opposing party state they occasionally smoke marijuana in their pleadings?
Is opposing counsel banking on the judge being a bro?
