Calendar
Opposing counsel sends me an e-mail to complain about not sending them notification of a conference.
My reply entails a description of the events during which opposing counsel was in the room to select the date jointly and may, in fact, wish to better manage their calendar.
Recovery
After forgetting to file key documents, my opposing number forgot to file the Order that would have put my client in contempt.
Gov't has given us a week grace period, in which time my client will have signed the documents I had forgotten about entirely.
No E&O issue! Saved!
Sharp
Despite numerous assurances by opposing counsel that a confirmation of adjournment was forthcoming, I was served at the 13th hour with confirmation of a motion for tomorrow.
My client's position is about to shift from an all but negotiated settlement to a request for an adjournment to trial on all issues.
What a waste of time and almost successful negotiations.
Served?
I had a self represented party serve their affidavit of service on me.
It was not accompanied by any other documents. Just the unsigned and unsworn affidavit of service.
TGIF.
Passing the buck
A client's relative telephoned me to complain about progress on the file.
I explain to them, several times, that I cannot do anything until the client completes necessary documents.
After the relative becomes belligerent on the phone, I advise that if they want to be helpful they can help the client fill the documents out.
I refuse to be blamed for someone else not having their shit together.
Darn if you do, Darn if you dont
My Principal is in trial all week. I have a shit load of shit to do so she has asked her partner to review my work before I serve. I feel like I am starting articling all over again because the partner's style and expectations are far different than my principals.
The very same things my principal wants a definite certain way, the partner wants the complete oposite way.
When these pleadings are served and they come back and my principal looks them over, I'll have my ass handed to me. But right now if I don't implement the partner's corrections, I'll have my ass handed to me still.
Looks like I'm gonna walk away from this ass in hand one way or another.
Surprise client?
I was recently e-mailed a draft contract from another lawyer, in which I am listed as having provided legal advice to one of the parties.
I politely responded to the e-mail to advise the lawyer that I did not act for either party in the matter and that, as I have other files with their office, they may have copied me on the file in error.
The assistant immediately e-mailed me back to insist that there has been no error and she was certain that my client would be in touch with me shortly.
While I may hope this turns into a file, everyone is going to be very disappointed when my first correspondence is to insist that the agreement is re-drafted in English, as I do not practice in French.
I sure hope "my client" is able to speak English...
Why?
Client has six weeks to review and sign documents.
At the 11th hour, the client has to courier them to my office so I can serve and file them at court.
Client neglects to sign the document.
We have now adjourned a conference months in the making, which my client desperately needed.
Mondays.
Lawyer 1: Oh yeah I tapped that (in reference to female lawyer making submissions to the court) Lawyer 2: You really did? I've been wanting to for a while ... how was she Lawyer 1: Lawyer in the boardroom, freak in the bedroom
Priorities
I have been working 80 hour weeks and all the while studying for the bar too ... my principal tells me I need to choose between the pre-planned family reunion and coming in on a SUNDAY to do more pleadings.
Then she adds "Make sure you got your priorities straight."
Happy Boss ... Unhappy Life
3 months of planning, 2 nights booked out of town, 1 boss to ruin your plans ... and $0 return policy on said booked nights out of town. Oh yeah that's what articling is all about.
Casual Friday?
An associate just asked why I am sitting in my office wearing jeans, drinking wine and posting on tumblr.
I told them when I do casual Fridays I do casual fucking Fridays.

Today I observed a new lawyer get instructed, at length, by a court clerk as to how to properly serve originating documents.
... The lawyer took notes.
Then, during subsequent settlement discussions, reached a settlement then refused to let her client sign until another lawyer at the firm reviewed the agreement.
If you are still tied to a partner's apron then you shouldn't have a long enough leash to leave the office.
Fearless
Today a client executed a power of attorney in which a paragraph is dedicated to their claim that they do not fear death. Not sure if crazy or badass.
Unsocial social worker
After a week of letters going back and forth, the breakdown in communication between my client and a government department has become clear to everyone involved.
The new social worker and my client are both monolingual in different languages.
This is not a problem anyone should have to deal with on a Monday.
Life tips
Advised a client that they would have fewer problems if they stopped f**king themselves over by doing stupid things.
A week later, no longer retained by client.
99 problems but that moron ain't one.
Discourtesy discount
There are a number of reasons to offer a client a discount - usually labelled "courtesy fee discount".
Perhaps the work done for them was either of lower quality than expected, or otherwise less successful. Maybe there was a thousand dollars of one line e-mails. Sometimes you just like the client.
I can only be impressed with a coworker who offered a client a $500.00 courtesy fee discount, with the contingency that they never again seek legal services or information from the firm.
