Top 10 Things You Need to Know about Preliminary Disclosures

1. Service of Preliminary Disclosures is a required part of the Dissolution process in California for both parties, unless Petitioner is entering Judgment by Default.

2. Preliminary Disclosures (often called PDODs or PDDs) are comprised of three forms: Income and Expense Declaration (FL-150), Schedule of Assets and Debts (FL-142) and Declaration of Disclosure (FL-140).

3. Petitioner must serve a PDODs at the same time as the Petition or within 60 days of filing the Petition. The Respondent must serve a PDODs at the same time as the Response or within 60 days of filing the Response. The time periods may be extended by written Agreement of the parties or by Court Order. 

4. Once you serve your PDODs, you must file the creatively-named Declaration Regarding Service of Declaration of Disclosure and Income and Expense Declaration (FL-141) with the Court.

Income and Expense Declaration: 

5. You are required to attach proof of income for the last two months to your Income and Expense Declaration. If you are a W-2 employee, attach your pay stubs for the past two months. If you are self-employed, a Profit and Loss Statement for the current quarter is acceptable, but a Schedule C from your last tax return is better. It is good practice to file your Income and Expense Declaration, though it is not required.

6. Remember that if you are attaching a Schedule C or pay stub to your Income and Expense Declaration, redact (black out) all sensitive information including Social Security numbers, birthdays, account numbers, etc. before filing it with the Court.

Schedule of Assets and Debts: 

6. The Schedule of Assets and Debts form is a chart of the community and separate property debts held by the party filing. You must include supporting documents for each item listed on the chart. 

Examples include: Blue Book Values on vehicles, insurance appraisals on artwork or jewelry, bank account statements, credit card statements, retirement account statements, etc. 

7. In most cases, it is appropriate to file your most current statements for all assets and debts listed on your chart. However, a small number of cases may require Date of Separation statements instead (i.e. statements from the same month that you and your ex separated). Check with an attorney to find out which approach is best for your individual case.

8. Declaration of Disclosure: Like the Schedule of Assets and Debts, the Declaration of Disclosure is not filed with the Court. Essentially, it a coversheet and checklist to ensure that you have served all the requisite financial information including the Income and Expense Declaration, Schedule of Assets and Debts, State and Federal Tax returns for the past two years, and the miscellaneous items below in item 9.

9. Other: On the Declaration of Disclosure requires that you provide documentation regarding:

    a) any valuations of assets that you have in your possession (e.g. real property appraisals), 

    b) a statement of community liabilities, and 

    c) a written statement regarding any offers received on community or separate property received during the marriage (e.g. offers on real property or businesses). 

There is no form to provide the items listed in a - c above. You can include a comprehensive list as a text document on pleading paper if you need to disclose assets, liabilities or offers requested on this form.

10. Declaration Regarding Service of Declaration of Disclosure and Income and Expense Declaration: An inelegant name for the mandatory form which serves as the proof of service for all of the Preliminary Disclosure documents. Be sure to have your attorney or another non-party over the age of 18 serve the opposing party/counsel. You can usually send Disclosures by fax or email, but mail service is always preferred.
