Briefly, the case she refers to was to do with the difference between supply of services and supply of goods. The uk, in providing opthamology services and glasses, exempted both from VAT. The ECJ said no, the relevant EU harmonisation law only allows you to exempt VAT on medical services. The UK then amended the VAT Act to correct the law. Now, the ECJ has softened in recent years and been more willing to accept that the supply of glasses constitutes the supply of a service (and is therefore exempt from VAT) in some circumstances.
Here’s the kicker though - whatever you think of the ruling of the ECJ that there should be VAT on corrective lenses, its part of UK law now. Go look through Schedule 9 of the the VAT Act 1994 and compare it to Schedule 6 of the VAT Act 1983. The former exempts only medical services from VAT whilst the latter exempts “the supply of services and, in connection with it, the supply of goods…”
The point is that leaving the EU will have no effect on this law. Maybe, at some point, possibly, an overpaid, unelected, meddling Civil Service apparatchik will remember or notice this particular tiny issue and suggest it be changed. But I seriously doubt its anyone’s priority.
