Did Steve ever sue the school?

he did not. he did have a talk with a lawyer who works at Stark Industries and decided to better spend his time working the Nick Fury angle, which was better around as that could have a more immediate impact on child safety in the school. 

But he did have another talk with the school principal, this time with a Stark lawyer with him, and that conversation was very good at addressing the rights of disabled children in the school. (and, it was implied, how far a  srs angry parent with fancy lawyers and a media-friendly face might take the issue otherwise)
