Whenever passengers book for a flight with their favorite air service, they expect to be transported to their destination according to schedule. In a perfect world, that is how things should work. But alas, we do not live in a perfect world.
There are unfavorable circumstances beyond the control of air travel service which would either delay, divert, or cancel the passengers' trip. During these adverse times, what rights to travelers have?
The United States Department of Transportation (or simply DOT), tasked in making travel efficient and secure, can provide answers with regards to passenger rights during such crises. Depending on the rules and regulations in the country, their reponse might also be applicable in other locations..
If most of the airline crew decided to stop operations and go on strike, passenger flights are certainly canceled. Should this happen, airlines are not required to put delayed flight travelers in a hotel, pay for their meals, refund the fare, divert departures or transfer it to other airlines. Those whose bookings have been hindered should only expect one thing - the air service is obliged to get them to their intended destination according to DOT.
Christopher Elliot, air travel customer expert, also shared tips and advice on how to go about the process should a flight be canceled, delayed or diverted due to unforeseen events.
'If the airline isn't operating flights, you are entitled to an immediate refund. Period,' Elliot added.
In the event that a certain passenger would rather have his flight diverted than refunded, most airlines are more than willing to help. Most of the times, they would book the new flight with their airline partners and may even transfer it to other partners but it is important to note such measures are not required. It is a good idea then to get flights from air services that are part of a network. This way, they will be able to divert bookings faster.
'It's always a good idea to know your rights before you fly,' Elliot said. 'That way you don't end up paying for something that the airline should have taken care of.'

Domestic airlines refund money to passengers

Domestic airlines in the country are refunding money paid for tickets bought by prospective travellers because they are unable to fly due to the hazy harmattan weather. Africa World Airline (AWA), one of the domestic airline operators, has so far refunded money to about 250 passengers who purchased tickets earlier. This follows the inability of the airline to continue its operations as a result of poor visibility. Meteorological Department has forecast severe harmattan weather till December 13, 2015. In an interview with the Daily Graphic, the Chief Operations Officer of AWA, Mr Samuel Thompson, said in situations where flights were cancelled through no fault of the passenger or the airline, the passenger was either put on another flight or the money was refunded. According to him, visibility required by airlines to fly safely to Tamale is 3,000 metres, while that of Kumasi is 1,600 metres and Accra is 800 metres. âNow, since Wednesday, because of the harmattan, the visibility has dropped drastically. From Thursday to now, the visibility in Tamale was hovering around 1,000 metres. This is way below the minimum requirement,â he expanded. Mr Thompson further said that since Thursday, the visibility in Kumasi had hovered between 200 and 1,000 metres, adding that as a safety precaution, when the visibility was low, the airlines were mandated to cancel flights. Mr Thompson was worried that the situation was adversely affecting business, âbecause when the aircraft is grounded like this, we lose money.â He was hopeful that the weather would normalise for business to resume, explaining that apart from the company losing money, the situation was also affecting the business activities of passengers. Lufthansa Crew Strike Cancels 290 Flights, Affects 37,000 Passengers
As expected the cabin crew union strike at Lufthansa began to disrupt the travel plans of tens of thousands of passengers early Friday morning, with the airline canceling nearly 300 flights.
The week-long strike, the result of a failed pension talks between the union and airline, began with walkouts on flights from Frankfurt and Duesseldorf, Reuters reports.
So far, Lufthansa says it has cancelled 290 planned flights on Friday, affecting around 37,000 passengers.
The canceled flights included 15 long-haul departures, typically international hours-long flights. However, the airline said eight long-haul flights are expected to take off as expected.
More flight disruptions are expected on Saturday, according to the union. For now, the walkouts will not affect Lufthansaâs hub in Munich until after Sunday, Reuters reports.
Despite the hefty number of travelers affected by the hundreds of cancellations, Lufthansa estimates 90% of the flights it typically operates on a Friday will go on as planned.
The strike was a result of a breakdown in last-minute talks between Lufthansa and the union. According to the airline, the union rejected the latest proposal that would have met demand related to current employees but would have created different retirement benefits and pensions for future employees.
Reuters reports that if the airline doesnât make concessions, the union will carry out the strike until Nov. 13.
âWe regret this course of action, but we see no alternative,â union head Nicoley Baublies said.

A new ruling is set to open the floodgates to holidaymakers seeking redress if flights are delayed. And as Matt Simpson finds out help in making claims will be close to hand.
THE last thing anyone wants when they are holidaying abroad is delayed or cancelled flights.
Hundreds of holidaymakers each year spend wasted time at airports waiting either to fly out or come back home.
Many airlines try to avoid paying out compensation to customers, but now more could be compensated for these wasted days after a new European Court of Justice ruling.
And Hanley-based lawyers Jefferies Solicitors are offering advice on claims.
Michael Jefferies, managing director, said: "It can be a bit daunting for customers if their flights are delayed and they want to claim compensation. It can very much be seen as a David and Goliath situation.
"For us, we will need to know the details of the flights so we could check to see if there were delays, how long they were delayed by and take it from there.
"People can claim on flights from up to six years ago and they can also pursue claims for each person in their flight party. The amount of compensation depends on the amount of time you are delayed by and the distance of the flight."
The ECJ ruling was made on a case, in which a passenger was delayed by 29 hours in 2009, while travelling with Dutch airline KLM.
The airline had rejected the claim for compensation, arguing it should not be liable for a spontaneous technical issue emerging just before take off.
The court ruled in favour of the passenger and Mr Jefferies feels more compensation claims could now be successful because of it.
He added: "If a flight is delayed and it is the fault of the airline, customers are entitled to compensation, but for example if it was due to adverse weather then they wouldn't be entitled to claim.
"The recent test case has seen technical faults included in the reasons entitling customers to compensation. The airline had tried to claim it was beyond their control. The courts disagreed.
"I very much think we will see more customers successfully claiming for compensation off the back of this case."
Stoke City fan Steve Leigh, of Clayton, is currently awaiting compensation from FlyBe after his 7am July 31 flight with the airline from Manchester to Cologne was cancelled just two hours before take-off.
"We pursued a compensation claim with FlyBe and we are now in the process of choosing between their offer of 275 euros or ÂŁ300-worth of vouchers," said the 36-year-old.
"To be honest it doesn't really add up to what we lost. The Saturday was pretty much written off and we felt rough on the Sunday as well.
"We had a bit of help with our claim from passengers who had been through the process before. We needed to look at the legislation surrounding claims.
"It would have been a big help to have had specialist help from a solicitor. I definitely think that would be beneficial to a lot of passengers."
Steve also believes the difficulty surrounding claiming compensation from airlines does put people off from following through with it.
He said: "It isn't really something you can do on your phone and many people don't have the time to follow it up.
"It can be hassle and people don't have time to take a day off to sort it. To be able to tell a solicitor a few details and let them take it from there would be a lot easier for passengers."
A Civil Aviation Authority spokesman said: "Passengers who want to claim compensation for a delayed or cancelled flight should, in the first instance, make a claim to the airline.
"If the claimant is unhappy with the airline's response, they can then refer their claim to the CAA's free mediation service and we will help, as much as we can. Once we have received a claim, we will contact the airline and ask them to clearly evidence why compensation is not due. We will then assess the information, form a view on whether compensation should be paid and inform the passenger.
"The CAA does not 'uphold' complaints as such, as we are not an ombudsman and have no legal powers to force airlines to pay out on individual claims. But , as a result of our free mediation service, we have achieved around ÂŁ10 million in compensation for passengers since 2012."
