A popular picture in any law firm is the scale. While traditionally for law firms the scale represents something else, in social media it can represent the balance of postings.

When it comes to the admissibility of social media evidence, the key is to make sure that you’re accessing the information in a permissible manner. Allied Concrete Company v. Lester – Another injury case, this was filed January of 2013 by Isaiah Lester, whose wife Jessica was killed in an car accident. Some of the information on his Facebook page appeared to be harmful toward his character. Fearing it could be used to discredit his client, Lester’s attorney told him to “clean up” his Facebook and MySpace accounts by deleting his insensitive photos, because “we don’t want any blow-ups of this stuff at trial.” Lester deleted the accounts, and his attorney’s office then signed discovery responses denying that he had any such accounts. The defense filed for a spoliation of evidence, which the judge ruled in favor for, ending in monetary fines for Lester and his attorney.

A general rule of thumb is that the content you share should be about 30% your own (if you have a sufficient pool of content to draw from) and about 70% from outside sources. The idea is to show that you are knowledgeable and up-to-date in your area of practice without making your account look like an endless, self-promotional commercial.

If you put something on social media, you can almost expect it to be used in court. As a rule of thumb, limit the use of social media while a case is in progress.

*This article primarily talks about Facebook, but all social media sites can be vulnerable.

“Be aware of the power of mutual contacts. Mutual contacts between experts, lawyers, clients, doctors, and witnesses can create certain perceptions. The power of mutual connections can play a role in trial. Recently, a defendant claimed to not know a particular witness in the courtroom. A quick Facebook search showed they are longtime friends on Facebook.”

Something else to think about is the so called “friend” feature on Facebook, the “follow” button on Twitter/Instagram and so many others. Whether you honestly “know” the person should start to matter because friends of friends add up quick and you never know who you're adding.

Law firms WILL look at social media and use WHATEVER they can to help their case.

Law firms want to be on social media in order to have a better understanding of the knowledge that is posted which becomes public to the world. There have been multiple occasions where the opposition’s postings on social media have been used in court. Whether the prosecution/plaintiff is using it against a defendant or the other way around, social media is something that can be used in court.

An example of this (mentioned in the article) is if an employee is home from work on “sick leave” and they're posting all over social media that they are at the beach.

Never identify a personal blog as a liated with or endorsed by the firm.

some thoughts..

I wanted to take a minute and let y’all know why the interaction between social media and law firms is important to me and why it should be something to look at.

Law firms can use social media to build their firm, get the word out, market their services and find new clients. BUT.. it can also use social media to check out future employees, use it to keep up to date on high-profile cases and even see how the public is reacting to the trials. If a law firm follows local news accounts and then views a tweet about someone getting arrested, they can jump on the opportunity to meet a client and slide them a business card.

This is something that matters to me because I come from a background of law enforcement family members and I am interested in becoming involved with the law in terms of becoming a lawyer. I’m interested in corporate crime, hence the Economics major.

I hope to show y’all how important it is for these firms to interact with people through social media.

Forbes says it best, social media is driving a business revolution. The sites such as Facebook, Twitter, and Instagram change how the businesses choose to go about their daily activities. It would behoove these businesses to post and keep their social media up to date in order to increase business.

For an off topic example; if I was on vacation and wanted to go out to eat and hadn't heard of a restaurant and wanted to look it up, I would go to the internet. If the business has a Facebook page with posted hours and a menu and/or an Instagram account with pictures of the daily specials, that would be an easy way to pick something to eat.
