I watched the full series. As a Texas Attorney, I can say medial malpractice is just a tough area. I practice in regular plaintiff's PI. Tort reform in the med mal field makes it hard to practice in. In TEXAS, (1) there are no attorneys fees because the American rule says the litigant pays for their fees unless a law provides otherwise (Texas legislature says yes, attorneys fees for breach of contract; but no, no attorneys fees for if your doctor is negligent), (2) all pain and suffering and mental anguish is capped at around 250k (car accident cases don't have this), (3) you have 120 days for a certain report to be ready (which needs to be by another doctor in that field or area; so, one "turning on" their own is required) (4) exemplary (punitive) damages are capped and have a higher burden of proof. So, the ability to help injured persons in medical malpractice cases is hard: the cost of Plaintiff's experts is high and you must have them to prove the failure of the standard of care, your non-economic damages are capped (because the legislature says so), its practically alll on a contingency because the average person can't pay for major litigation like this, and you don't get attorney's fees in this area. So not all firms can do this area of practice, the upfront costs can be very high and if you go to trial and do lose, the firm takes a big hit. So, patients that need a lawyer, but their case is right on the edge, they may not be able to find a lawyer to take their case. Its just sad. We do need to reform the tort reform. And I only scratched the surface, otherwise this post would be longer.
