A federal Judge today threw out Arizonaâs Governor Jan Brewerâs case against her own stateâs medical marijuana law, a law that was approved by the voters. Governor Brewer filed the complaint in May to seek a judgement from the feds on whether they would prosecute state employees with drug crimes for administering the states new medial marijuana program. Brewer and the State Attorney General, Tom Horne says they were reacting to a letter from the former Arizona US attorney who made the suggestion.
Yesterday, US. District Court Judge Susan Bolton dismissed the complaint, but did so without prejudice, a legal term that wouldnât bar the plaintiff from filing a case on the same matter in the future. Her ruling says that enforcement actions by federal officials do not pose a genuine threat to state officials implementing the law. She said that Brewer and Horne were unable to show any action against any state employees either imminent or threatened.
The ruling also points out that that they could find no legal precedent to show any state officials in other states have been prosecuted or threatened for participating in thier own states medical marijuana laws. The finding ultimately ruled that they could find not any credibe threat or a specific warning about initiating criminal proceedings against state employees enforcing the medical marijuana law. The US attorney letter was also addreseed in the ruling, since Gov. Brewer and Attorney General Horne were using it as evidence in their case.
