Oh gods, this felt like it came out decades ago. It hasn't even been 2 years
Bilbo was declared dead while he was away in the Hobbit (and had to do a bunch of paperwork to get declared alive again) but there’s no indication he was formally declared dead after leaving the Shire, even though most people assumed he had died.
Therefore I posit: having a missing person declared dead in the Shire requires the consent of their next of kin. Whoever Bilbo’s next of kin was at the time of the Hobbit (possibly Otho? I’m not sure) had him declared dead at the first opportunity but Frodo refused to ever do it.
Frodo had anxious hobbit bureaucrats knocking on his door every couple of years like ‘Mr Baggins… blease… it’s been 10 years… he was eleventy-one… can we fill out his death certificate yet’ and Frodo was like ‘absolutely not’.
Early on he genuinely couldn’t bring himself too but after a while it was more that he enjoyed irritating the local magistrate’s office than anything else.
I raise you: the hobbitish bureaucracy has no means to re-declare someone dead. They had no precedent to declare someone who was once-dead dead again. They would need the Thain, the Mayor, and the Master of Buckland to agree to changing the statute, and since the Thain and the Master are too amused by the whole henclucking that they haven’t gotten round to it just yet.
I’m upping the stakes with: last time Bilbo was declared dead when he was, in fact, not dead, they removed the law stating that you can have someone declared dead without a body, so when Bilbo left (happily aware of this legal loophole and snickering) he could never become legally dead again.
I am loving the implication here that Bilbo can literally never die in the eyes of the law. He’d love that.

a hobbit child misinterprets this and lies awake at night worrying that Mad Baggins is still out there and will appear in their room without warning
Alternatively: the laws for declaring somebody dead if they’re missing for long enough are still in place, but the magistrates are just refusing to enforce them in this particular case.
After all, last time they declared Bilbo Baggins dead— which involved filling out all the paperwork necessary to declare somebody dead without a body— he had the rudeness to show up again, forcing them to do a lot more paperwork, and this time with an indignant Bilbo having a go at them while they did it.
As a result, the magistrates have decided that they’re not going to declare Bilbo Baggins dead a second time unless they have a body, a coroners report explaining the cause of death, and a three day wake to make sure that he doesn’t get up and walk away again.
Centuries later, hobbit parents tell their children that Mad Baggins is forever gone from the shire— at least until the day when somebody is stupid enough to declare him legally dead, at which point legend states that he will immediately come marching back, demanding an explanation.
Lets talk about how hard it is to open up to someone about being sad for no reason. Lets talk about how hard it is to explain to your friends and family that you have this heavy feeling in your chest for no reason. Lets talk about how hard it is to understand why you’re having a panic attack while just taking a walk back home. Lets talk about how hard it is to understand your own self and how scary it is to feel like the whole world is falling on your shoulders and you have no idea why .

I’ve been thinking a lot Jaskier/Geralt/Yennefer relationship, like everyone else in this fandom. And I noticed some things that I like to share with all of you.
We are familiar with Jaskier’s love language towards Geralt, but the thing I’ve noticed is Geralt copies Jaskier’s words and he says some version of them to Yennefer.
Let’s check the facts
We have to revisit the bath scene and Jaskier’s line
“and yet here WE are”
In this scene Jaskier opens up about his feelings for Geralt. I know is subtext but is just so obvious that he cares for Geralt and he needs him. What I love about their relationship is that Jaskier chooses Geralt freely, there are no magic involved. It’s just a bard giving away his heart because he wants to, because he knows that Geralt deserves to be loved.
I want to focus in the word WE. By choosing this word Jaskiers says a lot about his relationship with Geralt, this means both of them are commited, both of them have feelings for each other, that Geralt needs Jaskier as much Jaskier needs him.
One more thing, this isn’t a life or death situation. Sure, Jaskier says he needs protection but we all know he just wants to show off his witcher and enjoy a lovely night with him. But then shit happens.
Let’s move to the next episode. After Jaskier leaves the house horrified by Yennefer’s threats Geralt is relieved his bard is alive and well, he even smiles!! But then he learns that Yennefer is in danger and he can’t let her die. Why? Because she saved Jaskier’s life. Geralt feels he has a debt with her. She saved his bard, so he must do the same for her.
He goes to Yennefer and they have this dialogue
Geralt: I’m here to help you
Yennefer: I don’t need your help You’re free. No longer under my spell.
Geralt: And yet, here I am
He uses almost the same words Jaskier said to him all those years ago. But there is a difference. He doesn’t say WE. He refers only to himself and with this act he denies Yennefer’s free will. Her wish is to become more powerful without anyone’s help. Geralt makes a wish and their fates become one against Yennefer’s desires. This is a life or death situation, Geralt is driven by his instincts, he is not thinking clearly. Their relationship is built on magic and spells, nothing like Geralt and Jaskier’s bond.
And then we finally reach the breaking point. “Rare species”
After Borch’s death Jaskier confesses his love for Geralt, once again:
WE could head to the coast. Get away for a while
One more time Jaskier makes clear that he can’t imagine a future without Geralt. That the two of them are an unit. Jaskier hopes that this time Geralt chooses him, that he will see what they mean for each other. Geralt does not. He leaves Jaskier behind and goes to Yennefer.
and that’s where the real pain starts. Because not only Geralt spends the night with Yennefer, in the morning he says to her
At a quick pace, we can make it back to the Pensive Dragon before sundown
This time, at least, Geralt includes Yennefer in his proposition. He is offering her the same thing Jaskier offered to him, to get away. He is not saying anything about a future together, he just wants to take her away of the dragon. But, again, he is going against Yennefer’s desires and she makes that perfectly clear. She is in the hunt for a reason, she wants her womb back.
In the end everything goes to hell. Three hearts are broken and the pains is unbereable. I could write more about that scene but I’ll do it in another time.
What all of this means?
For me it means that this three characters are trapped in a love triangle. We are supossed to read Geralt actions toward Yennefer as romantic, but Jaskier did the same for Geralt first. So, Jaskier actions are also romantic.
I also think that Geralt is fully aware of Jaskier’s feelings for him but he can’t believe that someone so human would love him without magic, and destiny and shit involved. and he knows it won’t last because Jaskier will die because of him and he can’t tolerate losing him. That’s why he pushes him away and he chooses Yennefer. But destiny is a bitch, right?

Ok wig i have a little theory add on,
I think Geralt sees yennefer as the possibly safer option, their destinies are bound because of his wish and she’s also magical and immortal, as in it would be more difficult for her to die on him. He’s got less of a chance of getting hurt with her. But jaskier is the only person to ever say those nice things to him, his love language is formed by how he is loved, mixed with his own baggage.
Jaskier taught Geralt love, and Geralt learned the fear that came with it on his own.
Absolutely!!! I agree with you. Geralt is so afraid to love because he is afraid to lose his loved ones. At the end because of his own fears he pushes both of them away. It’s so sad.
