The truth of the matter is this: Jo was walking on thin ice. The things she’s done were starting to catch up with her, the truth nipping at her heels. And it was only a matter of time before people started to put two and two together. Before the police started to put two and two together. She thinks Mercy is crazy for sticking around, especially when Jo has done nearly everything possible to persuade her not to.
As they’re sat eating shitty takeout on Mercy’s sofa, the last solution she expects is a marriage proposal. Or rather---a sort of marriage proposal. The technicality doesn’t really stop Jo from choking on her food. ❝ I’m sorry, what? ❞
According to SVU ( also known as Mercy’s cited source ) --- spousal privilege was a thing. And as crazy as it sounded, and as crazy as she thinks it is; Jo was actually almost considering it. After all, she wanted nothing more than for Mercy to stay out of her mess, so a loophole like this could be exactly what they needed. Still, part of her remained skeptical that it could even work.
❝You think that could actually work? ❞ She pauses contemplating for a moment. ❝Also, pro tip---if you’re gonna propose to a girl you should at least buy her something a little more romantic than chinese food.❞ The hint of a smirk on her face shows she’s taking this very seriously.
