Issuance of Pass is by Malaysian Immigration office
Before we go to more details, you must know general about Employment Pass in Malaysia. Employment Pass can be as Issuance Pass. The Employment Pass (EP) is a work permit that enables an expatriate to take up employment with an organisation in Malaysia. The pass is subject to the contract of employment (up to 60 months). The Expatriate Committee (EC) or relevant authorities must give approval for the foreign talent to fill a position before the issuance of an expatriate Employment Pass can be made by the Immigration Department of Malaysia.
Expatriate Committee have more service to the person who have salary above RM5,000 can apply the service. The service is Dependant Pass, Long Term Social Visit Pass and Social Visit for foreign maid. There are characteristic family member that can get immigration pass. Each service have their own characteristic need to follow. For example Dependant Pass. To get immigration pass family member must follow the characteristic which is children (under 18 years of age), A legally adopted child (under 18 years of age), Parents/Parents in law. The duration of each service is follow the person who have employment pass duration. Family member that need this pass. The person who employ at Malaysia must pass Expatriate Committee approval. After that, the person can apply these service. This is only 1st stage for applying Employment Pass.
2nd stage This is a process for the issuance of passes to Expatriates who have been approved by the Expatriate Committee (EC) or the relevant regulatory agencies. The person need to provide supporting document together with set application form. Supporting document is to ensure the person is legit to employ in Malaysia. If you have other document that relevant to supporting document must come together with application form. The supporting document is:
1. Letter of Authority from the company or letter of appointment as a company's representative.
2. Duly completed DP11 Form with passport size photograph.
3. Offer and Acceptance Letter or Employment Contract (RM10.00 Stamped) or Personal Bond which has been stamped with a RM10.00 revenue stamp for the application of a Visitor’s Pass (Temporary Employment)
4. One complete copy of the Expatriate’s Official passport (Two copies for PRC citizens).
These application must deliver by hand or post. You must submit to the exact address. An Employment pass is issued to the Expatriate to enable him to stay and work legally in the country. However there are certain categories of Expatriates who are allowed to work in this country on a Visitor’s Pass (Temporary Employment).
An Employment Pass or Visitor’s Pass (Temporary Employment) under the approval of the Expatriate Committee is subjected to the period of contract and the monthly salary of the Expatriate.
There is levy for Visitor’s Pass. Each sector have their own levy. These levy is different for Penisula Malaysia and ‘Sabah and Sarawak’. You must paid the levy for Visit’s Pass to valid. There are other charge for Employment Pass.
Immigration requirements:
l Any Citizen who requires a visa has to acquire a Visa with Reference prior to entry into Malaysia for the purpose of employment.
l A Visa with Reference can be applied for at the Malaysian Foreign Missions office after approval for employment has been granted by any Immigration Office in Malaysia.
l Please be informed that passes or I - Cards issued in Peninsular Malaysia to the Expatriate and his dependants are only valid for Peninsular Malaysia and does not include Sabah and Sarawak.
l The Expatriate and his dependant(s) are required to bring along their travel document(s) when travelling outside Peninsular Malaysia for the purpose of immigration clearance.
