Judge Backs Model Who Unknowingly Became the “Face of HIV” in NYC

A Manhattan judge has ruled in favor of Avril Nolan, a model whose face appeared in an HIV campaign back in 2013 without her permission.

According to the story, Nolan’s photographer friend took her photos for an online music publication and later sold the images to Getty. The New York State Division of Human Rights then purchased the images for its campaign.

Court of Claims Justice Thomas Scuccimarra said he reached his decision on the grounds that society considers HIV a “loathsome” disease that can arouse “some intense disgust in society.” A hearing in April 2016 will determine how much the state has to pay Nolan for defamation.
