Breeding Bird Surveys
All birds, regardless of species, are granted legal protection under the Wildlife & Countryside Act 1981, when they’re actively nesting. Special penalties are used for offences against Schedule 1 birds. If you’re planning a large scale development, you will most likely need a bird survey to identify how many breeding and winter birds already utilise that site. If Schedule 1 and principle conservation concern species are present, we will help you carefully plan the site in order to retain these habitats and avoid expensive mitigation.
Common reptiles are afforded limited legal protection under Schedule 5 of the Wildlife & Countryside Act 1981 (as amended). The purpose of this survey is to provide a high level of survey for common protected British reptile species in order to assist in demonstrating compliance with wildlife legislation and planning policy objectives. Namely for: » Viviparous lizard (Zootaca (Lacerta) vivipara), » Slow-worm (Anguis fragilis), » Grass snake (Natrix natrix); and » Adder (Vipera berus).
Water voles receive protection under Schedule 5 of the Wildlife and Countryside Act 1981 (as amended). They are protected from disturbance and it is an offence to deliberately, capture, injure or kill them or to damage, destroy or obstruct their breeding or resting places.
Great Crested Newts (GCN) are protected under the Wildlife & Countryside Act 1981 (as amended), it is also listed under Schedule 2 of the Conservation of Habitats and Species Regulations 2010, making it a European protected species. The survey for this highly protected species will provide the following: » Assess the presence or likely absence of GCN within the site and its local environs. » If GCN are found to be present on the site, give an indication of the population size of each species present. » Provide recommendations for further ecological survey work and mitigation where assessed as necessary and suggest potential enhancements.
In the UK badgers are primarily afforded protection under the Protection of Badgers Act 1992. They also receive limited protection under Schedule 6 of the Wildlife & Countryside Act 1981 (as amended). This outlaws certain methods of taking or killing animals. Picture of Badger It is illegal to wilfully kill, injure, take, possess or cruelly ill-treat a badger, or to attempt to do so and to intentionally or recklessly interfere with a sett. A sett is defined as "any structure or place or place which displays signs indicating current use by a badger." Sett interference includes disturbing badgers whilst they are occupying a sett, as well as damaging or destroying a sett or obstructing access to it.
Dormice are protected under the Wildlife & Countryside Act and is also listed under Schedule 2 of the Conservation of Habitats and Species Regulations 2010 making it a European protected species. The objective of this survey is to: » Establish the presence / likely absence of the hazel dormouse in suitable habitats; » Identify the distribution of the hazel dormouse and usage of habitats; and » Recommend ecological mitigation and enhancement where required.

THE ECOLOGY PLANNING PROCESS

To achieve this planning requirement you will normally need to submit an Extended Phase 1 Ecological Survey with your application as a minimum. This flow chart shows the normal procedure within the planning process in England with regards to ecology.
