Context: we were fighting a lich in his lair (party of 4 at level 8), and the swashbuckler rogue was sitting at 12 hp.

DM: Now, (rogue), since youre the only one he can see, hes going to cast a spell on you.

Rogue: Alright.

DM: How many hit points do you have left? This spell does 10d10 necrotic.

Wizard, who has just grasped the concept of counterspell: Can I counterspell at 4th level?

DM: Well, hmm. Its a homebrew spell from his staff… but it is a spell.

(5 minute discussion about whether or not he could counterspell a spell from a magical staff, what level the spell was, and if he could see him.)

DM: Youre going to have to roll to see if this works. The DC is 18.
