1. Vide RTI application dated 01.11.2011 the appellant has sought information on issues as contained in his RTI Application 2. CPIO reply dated 30.11.2011, has given the information to the appellant. 3. The first appeal was filed on 26.12.2011 as the desired information was not provided by the CPIO. 4. Vide Order dated 18.01.2012; FAA upheld the decision of CPIO. 5. Grounds for the Second Appeal filed on 08.02.2012 are contained in the Memorandum of appeal. 6. HEARING Appellant opted to be absent despite of our due notice to him. Respondents appeared before the Commission personally and made the submissions at length. DECISION During the hearing of the appeal, it is submitted by the respondents that they have provided the complete information to the appellant as per his RTI application dated 01.11.2011 on the basis of their reply dated 30.11.2011. It is to be seen here that the appellant, vide his RTI Application dated 01.11.2011, sought some information from the respondents on five issues as contained therein. Respondents vide their response dated 30.11.2011, provided the required information to the appellant on all five issues. Being aggrieved by the aforesaid response, FA was filed by the appellant on 26.12.2011 before the FAA, who vide his order dated 18.01.2012, upheld the decision of CPIO. Hence, a Second Appeal before this Commission. .....2 On careful perusal of the case file, the Commission finds that appellant was denied the required information u/s 8 (1)(h) of the RTI Act 2005 and also relied upon this Commission's earlier common order dated 10.07.2007 dealt in CIC/AT/A/2007/00007, 10 & 11 & order 20.05.2011, dealt in CIC/AT/A/2010/000969/SS passed in similar cases. Thus, Commission finds no legal flaw in the order of FAA dated 18.01.2012. Therefore, the same is here upheld. In view of this, the appellant's appeal is dismissed out-rightly.
