Fight for justice. After the arrest, prosecutors only care about convictions. Judges support prosecutors. If you are an innocent defendant, it's time to grow up. Take off rose-colored glasses. A prosecutor who actually cares about "doing the right thing" is a unicorn. Your innocence rolls of their back. Your life is just one domino in 100s for them. IF you are innocent, fight them on the only battleground they fear. Because IF you are innocent, the only thing they fear is the public discovering how corrupt they really are.
Imagine if doctors were rewarded for murdering patients. And there you have The American Prosecutor. Where is the incentive in the entire system for them to do justice? They are not rewarded for dismissing cases in which they know the defendant is innocent. They are only rewarded for conviction rates. And they are never held accountable. Think about it.
What is a prosecutor? A person who takes an oath to do justice, but enters into an office which will only reward conviction rates.
Why Doesn’t Prosecutorial Immunity End?
So many stunning books. So many brilliant scholars. So many intellects who have spoken on the topic. The facts are there. The reasoning is clear cut. Yet. . . it persists.
It was a mystery for a long time. But iVictim woke up one day and realized. . . it is the emotional piece. The face to the name. When victims are wronged, they are far too emeshed in the facts of their case. What it will take for prosecutorial immunity to END will be. . . a victim who can see beyond the crime committed, and speak to the system. Call out the prosecutors. Record their words. Present empirical facts for how they hide, how they skirt the system, how they represent the worst of the justice system.
iVictim will do this.
iBet DA will throw the tantrum of the ages over this. Accountability? The horror, the horror....
There will be no justice until the Assistant District Attorneys are harnessed and held accountable. It is their free reign to charge and ruin lives like mini Billy the Kids that underscores all that is wrong with the criminal justice system today. My experience with Manhattan Special Victim’s unit was, in its entirety, so deeply disturbing and painful that I can honestly say having them prosecute the crime was like being raped every day. On a positive note, I was able to forgive what my abuser did to me because how they handled my case left me empty, emotionally bleeding and replete. I used to be full and whole and wanted to change the world. They murdered my soul.
The criminalization of "hurt feelings" in the absence of malice or threat is absurd.
