2014 has been a year of feminist insurrection against male violence: a year of mounting refusal to be silent, refusal to let our lives and torments be erased or dismissed. Fetal homicide laws are supposed to offer pregnant women extra protection from domestic violence and other attacks. For example, a drunk driver who kills a pregnant woman can be charged with two murders in the 38 states that have fetal homicide laws on the books. But these laws are increasingly used against pregnant women by criminalizing them for having a miscarriage or by placing the "rights" of the fetus above the rights of the mother, much like the anti-choice personhood laws that have proliferated in recent years.
