i don’t think there is much awareness outside the field about how fucking stressful hearings in IP are
i‘m sure that court hearings in civil matters are super stressful, too, but jeez in IP you have anywhere between 10 to 100 technical documents to read and digest, you need to know everything about the patent you‘re defending or attacking, understand its technology in detail, craft a solid story on why it should survive or die on the day of the hearing, making your way among those 10-100 documents, and with it, also all the fallback positions on file
the preparation for a hearing takes anywhere from one day to a week depending on the size and importance of the case. you have to free your desk completely for that. nothing else exists and you need to dissect that case until the last nasty sentence of that random document that could kill your entire story
on the day of the hearing, you not only have to present your case but you also need to respond to the arguments presented by your adversary. on the spot. right after they speak so you need to listen and meanwhile prepare your next pleading.
a hearing in IP can be half a day long, most of the times 7-8 hours long, and sometimes two or three consecutive days long. regardless of how long it is, you need to keep your attention span at its peak. the whole fucking time.
if you’re lucky, the client is watching you and will see that you did your best even if the decision went against you. sometimes, the client is not there and you have to explain to them why you lost and it was not because you were not skilled enough.
at the very beginning of my career i hated hearings. i found the preparation unbearable (it generally requires working until late in the evening the day before). i also did not feel like i could ever be as skilled at reacting on the spot as the partners do.
now, with some years of experience under my belt, i find them extremely stressful and physically demanding, but i like to craft the story. i still have a long way to go in learning how to spot every single weakness or having effective answers to everything that is thrown at me on the day (and how to deal with the procedural traps waiting for me to stumble) but i think i enjoy them now. somewhat.
still, my brain now is of the same consistency of scrambled eggs and i should go to sleep
