Can you give me a update about what happened in court when you were arrested ? Did you get a misdemeanor ? Also did it affect your current job ? Did they take your finger prints ?
My court date was set for like 4 months after the incident. I got civil demands in the mail which I ignored because I read on forums that it doesnāt help your case in court, get sent to collects, or effect your credit; and up until this day it stands true.
I was sentenced in Aug. 2014 of a Class A misdemeanor. And when I went to my court date I was first called into this tiny room with a desk and two chairs that was practically in the middle of the waiting room I was in. I talked to the DA who was actually wearing a super cute J. Crew top that I had stolen previously... anyways. She read over my case as I sat there. Thatās where I saw the statement from the LP that apprehended me which I mention in my previous post. I read it upside down though, she didnāt just hand it to me. She asked me how I plead and had me sign off on that, no contest. She then gave me the option of 1 year supervision probation with community service and a class on shoplifting -OR- 2 weeks in home detention (house arrest) or county jail decided by the judge.Ā
I had a bunch of anxiety during this whole process especially when choosing what I was going to be sentenced to. I asked the DA if I was still able to use my red card while on probation and she said she believed so. I originally chose probation because it freaked me out that I could choose in home detention/JAIL and potentially have the judge chose real jail instead of house arrest.
I wait some more and then get called into a court room namedĀ āFirst Appearances.ā I take a seat in the audience section and then theres a tv in the back that comes on and the judge starts sentencing people who were being held in jail after being arrested until their first court appearance, which was happening right now. It was strange.
They then started calling people in the court room up to the podium and most of them had lawyers. and they had lawyers because every one in that room besides me was there because theyāve gotten MULTIPLE DUIāS. Iād rather the court room be filled with a bunch of thieves rather than a bunch of people with no regard for human life. But I digress. The judge calls me up looks stuff over and pretty much says,Ā āProbation for a year, 100 hours community service, and a class on shoplifting. Hereās the info for probation, stop by the office before you leave here.āĀ
I go to the office and the receptionist checking me in, legitimately treated me like I was a terrorist. She didnāt even see my case or know why I was there. It bugged me because she probably chooses everyday to be a nasty person at work. She gave me a fucking packet to fill out about myself. Iām not really from the US, Iām from the rural north where you shoot people who come on your property. I never have the location turned on on my phone, I donāt have the option checked on chrome where it sends all your searches to every living creature. I have my webcam covered up on my laptop and I know that 9/11 was an inside job.Ā The things that they were asking about, were way too personal. So I answered the ones I felt comfortable answering and when the lady called me back into her office and reviewed my packet, she gave me a professionalĀ āwhat the fuck???ā and I told her āI donāt feel comfortable giving you that information.ā She told me,Ā āWell, this is part of your probation.ā So I said,Ā āThen I wonāt be on probation anymore. Can I go speak to the judge again so I can choose the other option of my sentencing?ā She said yes so I took back the packet and went back to the court room.
They were at lunch, and they were seriously at lunch for 2 fucking hours. Spent that entire time freaking out. Some lady behind some glass finally opened her blinds and I went up to her and told her my situation. She said I can see the judge again but I have to see another DA first. So I wait until another DA calls me into their tiny office. A different lady calls me, I can tell sheās not as soft as the other lady which really proves itself during the interaction because she reviews my case and then says,Ā āIām giving you the option of probation (that same shit as before) or 1 month in home detention or jail.ā I said,Ā ā1 month it was 2 weeks before!ā She said,Ā āThis is very serious blah blah blah.ā I decided fine, Iāll do it, whatever, Ill come out a better person.Ā
I sign the papers and go see the judge, except again it was a different judge since this technically wasnāt my first appearance anymore. I tell him Im a student and I really want in home detention. He grants me that and since itās aug. he tells me that I donāt have to start my month until after the first of the year. Which is great because my family was expecting me to see them for Christmas so that was a dodged bullet.Ā
I meet with the lady whoās looking after me during my in home detention and we got along great. The whole in home detention process was a lot more comfortable than the probation process so I was in a better mood which I think rubbed off on her because Im sure she deals with people all the time who are in a sour mood. The time, effort, and MONEY that went into in home detention was significantly less than probation. I FORCED it into being a growing experience which I feel good about because I truly believe allās well that ends well.
