this is in wake of several things happening over on deviantart to a very large community and i wanted to make my stance 100% clear on it
updated portion of the tos is as follows:
You may NOT attempt to sell my art with a character design without paying my redistribution rights fee — I. This means charging the cost of art commissioned from me in addition to the cost of the design itself, as this is a breach of copyright law (you cannot sell my art, as the rights to it do not belong to you. — II. If you fail to comply with this term, you will be charged for damages (how much you sold my artwork for specifically). If you pay the additional cost to obtain the right to redistribute and you transfer this right (i.e sell the character and my art) you must: — I. Link the new owner of the piece to my TOS. — II. Pay me a royalty fee when you sell my art with a character, whether you were the original commissioner or not. —III. Inform me who now owns the right to redistribute.
this may be subject to future revision, as is all my terms of service. this term is part of us copyright law and is non-negotiable (unless you wish to pay for the right to redistribute) and i will act as the law allows me to
