Carfax and European Data Protection or: How to stop worrying and sell a total-loss Audi luxury sedan as mint
Look at the pictures taken from an online ad (left) – and how the car looked like a couple of months before (right). It’s the same vehicle. Here’s the story.
Some weeks ago, we found an interesting offer on mobile.de: a 2013 Audi A8 4.0 Turbo quattro, long version, with just 25000 km on the odometer for € 39900.
On the phone, the dealer confirmed the A8 was still available and we made an appointment. Two days later, the editor was on site and found the A8 even more impressive: Immaculate light grey leather interior, wood and aluminum finish, no visible damages, clearly well-maintained. But … that rear bumper. In September 2013, Audi facelifted its flagship. A subtle change included the integration of the exhaust into the lower rear bumper. This A8, however, was registered in July 2013, but has the facelift bumper from September. Suspicious.
We asked the dealer, a German lady in her late forties with a taste for strong tobacco and coffee, and she acted like she had no idea – first. Then we asked, if the car could have been involved in an accident and somebody replaced the damaged original bumper with a facelift one. After a while, she admitted she bought the car in the US, hence „did not know about its history, but it could have had a crash“.
Note: in the ad, the dealer did neither mention the A8 was an US import, nor it could have been involved in an accident.
We took a picture of the VIN (vehicle identification number) on the windscreen and left. Something was fishy about it. The next day, we called Carfax Europe. Carfax offers reports about vehicles, provided by US traffic authorities. A typical Carfax report features registration dates, mileages, service notes – and Police reported damages.
What we found out about this A8
• it had always been serviced at Audi since 2013 • it was involved in a collision and towed in Naples, Florida Januar 26th 2016 • the front and frame had primarily been damaged. multiple airbags deployed • it was reported a total loss vehicle (damage >75%) by an insurance company. estimated repair cost: $ 23421 • it was sold through an auction and shipped to Klaipeda, Lithuania
In other words: the dealer was trying so sell us a piece of junk. And she knew it. Carfax offers dealer discounts and she definitely had a report. We also assume the A8 was „repaired“ in Lithuania for cheap by her „business partners“ with no OEM guarantee and then polished for showroom presentation in Germany. What you buy here, is not only a threat for public traffic safety – it is a threat for your own life.
The other point is: If the total loss crash had happened in Europe, there’d be no safe way to verify the history of the A8. There is nothing like Carfax in Germany, for example. Data protection laws have it the only legal information for Germany-registered vehicles is service and owner notes on paper, exclusive to the official owner, written and stamped by hand. An archaic, medieval, intransparent and easy to manipulate sheet of nonsense.
What does that mean?
It means, the dealer could have it „fixed“ somewhere in Eastern Europe, where work is cheap, and re-sell it as mint, just like she does now, but there’d be no proof and evidence of the fraud. There is evidence thanks to Carfax, though.
Unfortunately, most EU customers think the US car market isn’t transparent. The opposite is the case, as our A8 demonstrates. And, by the way, personally identifiable information, often mentioned by data protection activists, are not part of a Carfax report.
The Audi A8 L 4.0T quattro is still available and the price just dropped to € 38480. Still not enough to risk your life.
