If abortion becomes illegal or at least limited to extreme cases again, what should be the punishment for a woman who gets one without authorization? What should be the punishment for the would-have-been father? Does he get a lighter punishment if he convincingly claims he didn't want her to abort? Does she get a lighter punishment if she convincingly claims she was pressured into aborting by others? Lastly, what if they're married and have children but struggling to support the family as it is?
That all depends on the scenario. Every abortion has its own reason, while hardly any of them are justifiable, each case needs to be taken as an individuals. Grouping together a type of crime and giving the same sentence each time is hardly justice. Honestly, I think that when abortion does become illegal, more time should be spent on its prevention than what to do when it happens.
I guess you could say I'm more on the harsh side of sentences, and I believe that abortion should be treated the same as murder, after all, it is the illegal killing of another human. Though jailing a person for getting an abortion due to financial issues would only worsen their own condition, empathizing the need for an in depth view of each case, its reasons, those involved, and how can we truly make what was wrong right again.
The fathers intervention would be something hard to prove, unless you have it all taped or messages through text and whatnot were recorded. No matter what though, the fathers responsibility should be just as equal as the mothers. Unless you can without a doubt prove that the father had no idea of the murder, and had no part in it, then the father should be tried on the same charges as the mother.
Parents have been incarcerated with children before. What happens is covered here, and I'll take a closer look at it later.
Once again, my own opinions, I don't speak for the entire community here. I'm not heading towards a career in law, but in the sciences, so I'm just going off from what I know from trials on TV and such. Anyone ekse want to add input?
