They don't.
(a) That conversation was set in an AU where their relationship is very different from in the canon 'verse but (b) it's still not a romantic relationship at all.
They're platonic partners in the AU, and have been for probably 25 or 30 years at the point that conversation takes place. They love each other very strongly, but it still isn't a romantic love (though I know as well as anyone how tough romantic love can be to define). To my knowledge, marriage isn't something either of them had even considered prior to that point, at least not in any serious capacity, because from a social standpoint it didn't fit their relationship it all.
The only reason it came up is that Dan was diagnosed with a (unspecified for the time being) rather serious illness and the two of them are facing the reality that he could be incapacitated, or die. And it turns out your significant other dying sucks marginally less if you're legal married to them.
So what they are discussing is a legal contract. Their relationship is the same as it has always been.]

I can totally see it happening, especially after Dan gets sick.
He would just be "Well I still think marriage as a social institution is kind of dumb and wow this is going to make me uncomfortable for a bit but it would be so much easier than what I would have to do otherwise from a legal standpoint to make this work, I'll deal with the rest."]
