bassiter got terminated :(

so my blog got terminated for copyright strikes on my specific music edits. it was a 3rd strike, but i’d had no idea of the first 2 because i never check the email that was attached to that account. i’ve moved to this one for now, HOPEFULLY only temporarily because i’m trying to appeal to tumblr based on the fact that the edits were creative content. at the very least, i’m hoping i’ll get access to my posts back so i won’t have just lost all that stuff lmao

anyway in the meantime follow this blog for updates and my usual brand of posting

Bassiter changed his profile picture to one from when Carlton went crazy from the gas leak(I forgot the episiode name) which lead me to this conclusion. So, #new-profile-pic I guess

so it’s seeming like the only way that i’m going to get anything restored is if i can effectively dispute at least one copyright claim 

this is the email that i sent to tumblr support:

I've recieved a no-reply email telling me that my account (bassiter) has been terminated after 3 copyright violations in the past 18 months. Now, I know that this isn't an outright excuse, but I'm hoping for some mercy:

I had literally no idea of any of these copyright notices until having just seen that my account was terminated because I never check this email. It didn't occur to me that any of my specific music edit posts even WOULD be copyright claimed because some (heavily edited!) songs that I've posted have been immediately claimed the moment I even tried to upload, so I could only assume that anything that didn't get claimed like that wasn't an issue at all. Also, all of these posts have been HEAVILY EDITED remixes that should fall under creative content. Though I'm afraid to file an appeal for the rights because the risk of being legitimately sued in spite of that seems too great.

I've had this account for years and it contains SO much of my life on it. Is it at all possible that I can have my account back? I'll gladly promise to never post anything even resembling those edits ever again. At the very least I'm genuinely begging to at least have private access to the posts from my accounts because a lot of it was never backed up. Thank you in advance.

and i finally got a response, which only basically repeated the original termination email and simply told me how to file a counter-notification against DMCA. now, the only way i can imagine i’ll succeed at that is by claiming Fair Use, but here’s the issues:

i can’t tell if my edits count as Fair Use or not

it seems like there’s a risk in disputing if i’m not 100% sure???

i’m going to reply and ask if that appeal is the only way at all that i’m going to get any access to my posts whatsoever, but in the meantime can someone who understands the law better than i do PLEASE tell me what i should do

oh also idk if it was clear to everyone but regardless of what happens i definitely can’t make specific music edits anymore. at least not on any kind of regular basis. ngl though that’s the one real silver lining to all of this bc i was getting genuinely sick of it and i hadn’t even gotten paid to bump any of them up in like months lol

ok from what i can tell, there’s probably no way i could actually make the case that my specific music edits count as Fair Use. but this is what i sent back to tumblr support:

Is successfully countering the DMCA claim the only way that I'm going to get anything back? Even simply restoring sideblogs or giving me private access to my account?

Also, actually - please tell me, how is it fair that my account would be terminated for what I could not possibly have KNOWN was copyright infringement before posting it? On multiple occasions when uploading song edits, tumblr has immediately responded with letting me know that that particular song had a copyright on it and therefore I couldn't upload it at all. It seems that either 1) these claims on my posts that have gotten them removed happened LONG after the fact, or 2) tumblr's copyright detection is extremely faulty. Why would *I* be to blame for either of these? I couldn't even possibly know that there WOULD be claims - as evidenced by the fact that I've posted well over a thousand song edits with only 3 takedowns. 

If the answer is that after a single claim I should have backed down and stopped posting edits entirely, then couldn't this be solved by simply removing all of them? Why does my entire account, including blogs that never had any of the copyrighted material on them, have to be deleted? I'd be happy to suffer the loss of that particular content if it meant getting the rest of my account back.
