so it’s seeming like the only way that i’m going to get anything restored is if i can effectively dispute at least one copyright claim
this is the email that i sent to tumblr support:
I've recieved a no-reply email telling me that my account (bassiter) has been terminated after 3 copyright violations in the past 18 months. Now, I know that this isn't an outright excuse, but I'm hoping for some mercy:
I had literally no idea of any of these copyright notices until having just seen that my account was terminated because I never check this email. It didn't occur to me that any of my specific music edit posts even WOULD be copyright claimed because some (heavily edited!) songs that I've posted have been immediately claimed the moment I even tried to upload, so I could only assume that anything that didn't get claimed like that wasn't an issue at all. Also, all of these posts have been HEAVILY EDITED remixes that should fall under creative content. Though I'm afraid to file an appeal for the rights because the risk of being legitimately sued in spite of that seems too great.
I've had this account for years and it contains SO much of my life on it. Is it at all possible that I can have my account back? I'll gladly promise to never post anything even resembling those edits ever again. At the very least I'm genuinely begging to at least have private access to the posts from my accounts because a lot of it was never backed up. Thank you in advance.
and i finally got a response, which only basically repeated the original termination email and simply told me how to file a counter-notification against DMCA. now, the only way i can imagine i’ll succeed at that is by claiming Fair Use, but here’s the issues:
i can’t tell if my edits count as Fair Use or not
it seems like there’s a risk in disputing if i’m not 100% sure???
i’m going to reply and ask if that appeal is the only way at all that i’m going to get any access to my posts whatsoever, but in the meantime can someone who understands the law better than i do PLEASE tell me what i should do
