Music Industry Jumps on Aussie Piracy Site Blocking Law

The Australian parliament has passed legislation last year allowing rights holders to ask a court for a website-blocking injunction to be applied for piracy sites. Take advantage of this legislation, a group of “the world’s largest record companies have joined forces” to restrict access to torrent site ‘Kickass Torrents’. The first use of the legislation came in February this year when Foxtel and Village Roadshow put forward their case for internet service providers to block local (Australia) access to sites like “The Pirate Bay” and “SolarMovie”. 

This group has also applied to block related proxy sites, making it more difficult for Kickass Torrent operators to employ quick workarounds to restore Australian access. ARIA members Universal Music, Warner Music and Sony Music said that the site “exploited creativity of others and gave nothing back to artists, songwriters, record labels and music publishers who had their music stolen.”  This is a big step and potentially important step for the music industry who has seen a major decline in physical album sales. Music is already a hard business to monetize and capitalize (as opposed to other media industries) and speed + proliferation of music pirating sites has not helped the industry in any way. However, although piracy is clearly illegal, how to solve the problem is not as clear. The next issue that arises is, how do you implement a “block’, should one be implemented by the court? A rift has already emerged in implementing blocks from a technical standpoint. One case puts forward a block on a DNS (domain name system) level, while another case pushes for the blocking of IP addresses URLs. However, IP addresses change rapidly, and domain names can be easily changed....

Chapeau to a ground-breaking move of British politics in favor of Net Neutrality. Other countries should take an example on that. I'd expect Jean-Claude Juncker to propose something similar on the European level, to move towards the right approach of education and awareness in Internet politics

London – 19th July 2014: Representatives from the UK's creative industries and major Internet Service Providers (ISPs) have come together with the support of government to launch Creative Content UK, a ground-breaking new partnership that will boost consumer awareness of the wide array of legitimate online content services and help reduce online copyright infringement. Creative Content UK will comprise two key components. The first, which will launch before Spring 2015, will be a major multi-media education awareness campaign, led by content creators and part-funded by government, that aims to create wider appreciation of the value and benefits of entertainment content and copyright. The second component is a subscriber alerts programme that will be co-managed and co-funded by ISPs and content creators and due to begin at a later date. Participating ISPs will alert and advise subscribers when their accounts are believed to have been used to infringe copyright. Account holders will receive an alert from their ISP, advising them unlawful filesharing may have taken place on their connection and offering advice on where to find legitimate sources of entertainment content. Speaking today Business Secretary Vince Cable and Culture Secretary Sajid Javid announced the Government's support for this initiative and pledged £3.5 million in funding for the education awareness component of the campaign.

...the various ways in which Congress revised our copyright law in the U.S. have created a ridiculous anomaly — no published works enter the public domain at all here in America until 2019 (assuming the law is not tinkered with again).  That is because under the 1976 Copyright Act, which took effect on January 1, 1978, all works that were already subject to copyright protection at that time, which was any published work that had been published, with copyright notice, after 1922 (1978 minus 56, which was the previous maximum copyright term), were simply given a 95 year term of protection.  Thus, in the U.S., no copyrights will expire for published works before January 1, 2019, when works published in 1923 will become PD.
