We live in a world where almost everything constitutes as copyright. Most moneymaking ideas have already been thought of and belong to someone else, but the copyright laws and regulations remain far short of satisfactory in this time of technological advancement and piracy worldwide. I would like to start by telling you a story. It’s about a woman whose thirteen year old month baby danced in front of her and ended up in her twenty nine second home video, which she put on YouTube. However because the barely audible 'Let’s go crazy' song by Prince was being played in the background, the Universal Music Group were able to sue her under the copyright infringement act for up to one hundred and fifty thousand U.S. dollars (Lessig 2008). This ridiculous scenario draws attention towards just how outdated copyright infringement laws currently are. Netflix is competed with by similar companies in this respect including Amazon, and is paralleled in other industries, as highlighted by Spotify’s central role in the commercial market of music. This reflects hope for the future, but also indicates that vast change needs to occur to reach such a future.
In his captivating video, Ferguson (2012) depicts how the evolution of ideas and society are conflicting, as new ideas evolve from ideas that already exist, as evidenced by the replications surrounding Ray Charles’ music discussed in the video. However by placing ownership and copyright on ideas, society is blocking this process. The main discourse throughout the video is that the economically driven process of ‘owning ideas’ inhibits creative evolution, as morphed versions of old ideas, adapted to new contexts in new ways, is how the evolution of ideas has occurred for thousands of years. And I couldn’t agree more. There is a need for change in the blockages of idea evolution, and the outdated and ineffective copyright infringement laws (Ferguson 2012).

4. Copyright
deviantART is, unless otherwise stated, the owner of all copyright and data rights in the Service and its contents.
Immediately following:
Individuals who have posted works to deviantART are either the copyright owners of the component parts of that work or are posting the work under license from a copyright owner or his or her agent or otherwise as permitted by law.
Note that it says artists own THE COMPONENT PARTS. Not exclusive rights to the entire work itself.
deviantART does not claim ownership rights in your works or other materials posted by you to deviantART (Your Content).
But wait....
While they're not claiming ownership rights, the artist still has no say in what DA does with it, nor are we allowed to receive royalties.
As per the Submission Policy:
Term. The term ("Term") of this Agreement starts on the date that the Artist Materials are initially uploaded to any deviantART Site(s) and continues until either Artist or deviantART terminates this Agreement in writing, with or without cause or by the removal of Artist Materials for the purpose of termination...
So basically, this is in effect from the moment you upload your work until you or DA formally write termination notices, or you remove the work. Now, the policies themselves.....
3. License To Use Artist Materials. As and when Artist Materials are uploaded to the deviantART Site(s), Artist grants to deviantART a worldwide, royalty-free, non-exclusive license to do the following things during the Term:
a) to prepare and encode Artist Materials or any part of them for digital or analog transmission, manipulation and exhibition in any format and by any means now known or not yet known or invented;
(Basic "we're going to do what needs done to publish the data you submit on a website" stuff, "by any means". They can do what they want.)
b) to display, copy, reproduce, exhibit, publicly perform, broadcast, rebroadcast, transmit, retransmit, distribute through any electronic means (including analog and digital) or other means, and electronically or otherwise publish any or all of the Artist Materials, including any part of them, and to include them in compilations for publication, by any and all means and media now known or not yet known or invented ;
They're allowed to publish it wherever they want, WITHOUT YOUR PERMISSION because you already agreed to allow it by checking that little "I Accept" box.
Notice the lack of clause saying they have to credit you? It's usually anonymous when they do that.
c) to modify, adapt, change or otherwise alter the Artist Materials (e.g., change the size) and use the Artist Materials as described in Section 3(b)
(So they can add watermarks, size them down, crop it, edit the image, and send it "in any format" however they feel. YOU JUST ALLOWED THEM TO MESS WITH YOUR ART HOWEVER THEY LIKE!)

d) the right to sublicense to any other person or company any of the licensed rights in the Artist Materials, or any part of them, subject to the terms and conditions of this Agreement.

So they can give WHOEVER THEY WANT the license to use your works. And you ain't got NOTHING to say about it, because, haha - you don't have the right or title to say anything about what we use it for!
f) During the Term, deviantART's licenses under this Agreement include the right to use any part of the Artist Materials in the promotion, advertising or marketing of the DeviantART Sites.
g) As used in this Agreement, the term "Artist Materials" means any content uploaded to the deviantART Site(s) which may include without limitation Artist's name(s) (including professional names), trademarks, trade names, likenesses, photographs, biographical materials, audio-visual materials, artwork, liner notes, and other graphical, textual, video, film or audio materials and any and all "skins," computer-generated images or other artwork or images that Artist submits to deviantART in any medium or format whatsoever.
We, own, NOTHING. Not even custom coding, not even fully-original drawing, WE DON'T EVEN OWN OUR OWN USERNAMES.

c) To the extent that the Artist Materials contain the name(s), group name, photograph and/or likeness(es) and biographical materials of any other person, Artist hereby grants to deviantART a worldwide, royalty-free, non-exclusive license to use them in connection with the distribution, exploitation, promotion, marketing and advertising of the Artist Materials, as described in this Agreement, during the Term.

5. Limitation Of Rights
The rights and licenses granted to deviantART under sections 3 and 4 of this Agreement require deviantART to obtain Artist consent before deviantART makes any commercial agreement with anyone else to separately buy, license, re-sell or re-publish or commercially use any Artist Materials not in association with deviantART but as an individual work of art or as a group of works from a single Artist in isolation from any other works. No additional consent is required for any other licensed uses under this Agreement of Artist Materials either as part of the deviantART Site(s) or in connection with the distribution of content groups from the deviantART Site(s) and/or for uses of the Artist Materials made at the discretion of a visitor to the deviantART Site(s) or other users under agreements with deviantART. deviantART will contact Artist in writing about any individual commercial uses of Artist Materials instigated by deviantART.
Sooo, dA's SUPPOSED to get your consent before sending it out to anyone not affiliated with dA itself. IN WRITING. But it doesn't matter whether they do or don't, because as this next point shows, you can't get any credit or compensation for it anyways.
6. Payment
Unless otherwise agreed between Artist and deviantART in a writing from deviantART, the license granted to deviantART under this Agreement is royalty-free.
That means if DA gets to use your work, you get absolutely no compensation.
Surpriiiise. You can't profit from your art.
8. Third Party Payments.
Artist is responsible for all licensing, reporting and payment obligations of any kind to third parties in connection with the Artist Materials.

I've been a deviantArt member for much longer than these terms were in effect, so I had never really read them before, because I assumed they'd remained the same... and I was a naive little twelve-year-old who just wanted to share some art.
I'd always figured my 90%-fanart gallery was safe... but I do have original works there, my OCs are my precious babies and NOBODY had better touch them or I'll stalk their nightmares til death... But I know people who actually NEED the support of royalties and a website that can reliably protect their rights, rather than saying "It's all you", or implementing vague and simple clauses that leave our rights unestablished and largely unprotected.
Isn't it funny that most of the Submission Policy is all about DEVIANTART'S rights?
What about OUR rights? Not even deviantArt's copyright policy page defines EXACTLY what we're allowed to do with our own works! But there's all that focus on what THEY'RE allowed to do... And the only mention, really, says that we don't get royalties. Which means a company probably paid dA to use our art, but DA's the only one profitting. NOT THE ARTIST!
Thank god for the user-run commissions system, because DA takes 20% of your pay for itself if you use their ~official~ system.
The bottom line is it's a good place to display your art. But it's... probably not the most secure, and they're not going to protect your rights if your art is stolen anywhere besides the site.
