Apparently “burglary” does not only apply to theft.
According to dictionary.law.com:
The US state it’s relevant to in the fic I’m researching this for typically lists burglary as a third-degree crime (so 3-5 years in jail and up to a $15,000 fine), but it can be bumped up to a second-degree crime if it involves injuries, a deadly weapon, or a threat of violence/injury to another person (5-10 years prison with “an assumption of imprisonment even for first time offenders”).
